BILL NUMBER: S4447 TITLE OF BILL : An act to amend the vehicle and traffic law, in relation to disregarding a lawful order of a police officer to stop a motor vehicle PURPOSE/SUMMARY OF PROVISIONS : To criminalize intentional flight by a motor vehicle operator to avoid apprehension by a police officer. A new section 1102-a is added to the Vehicle and Traffic Law. This section makes it a misdemeanor for a motor vehicle operator to intentionally flee or attempt to evade a police officer after having been signaled or directed to stop by such police officer. JUSTIFICATION : Current Vehicle and Traffic Law §1102, a traffic infraction, is inadequate to deter motorists from attempting to evade apprehension by police officers for such offenses as driving while intoxicated, which is a misdemeanor. While virtually all police departments regulate pursuit of fleeing motor vehicles by police officers, those pursuits which do occur jeopardize the safety of all involved, including innocent citizens. Intentionally fleeing or evading apprehension by a police officer should be punished as a misdemeanor.

KRUGER -- read twice and ordered printed, and when printed to be committed to the Committee on Transportation AN ACT to amend the vehicle and traffic law, in relation to disregarding a lawful order of a police officer to stop a motor vehicle THE PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND ASSEM- BLY, DO ENACT AS FOLLOWS: Section 1. The vehicle and traffic law is amended by adding a new section 1102-a to read as follows: S 1102-A. EVASION OF A POLICE OFFICER. NO PERSON, WHILE OPERATING A MOTOR VEHICLE, SHALL KNOWINGLY FLEE OR ATTEMPT TO ELUDE ANY POLICE OFFI- CER AFTER HAVING RECEIVED ANY SIGNAL FROM SAID POLICE OFFICER TO BRING THE MOTOR VEHICLE TO A FULL STOP. ANY PERSON VIOLATING THIS PROVISION SHALL BE GUILTY OF A MISDEMEANOR. S 2. This act shall take effect on the first of November next succeeding the date on which it shall have become a law.
