BILL NUMBER: S4982 TITLE OF BILL : An act to amend the tax law and the state finance law, in relation to establishing the volunteer firefighting and volunteer emergency services recruitment and retention fund and authorizing gifts to such fund through a state income tax check-off PURPOSE OR GENERAL IDEA OF BILL : This bill would make it easy to voluntarily contribute to a fund to be used to help enhance recruitment and retention efforts for volunteer firefighters and volunteer emergency workers. SUMMARY OF SPECIFIC PROVISIONS : Section 1 amends the tax law by adding a new section 209-G to enable tax payers to make a contribution to the volunteer firefighting and volunteer emergency services recruitment and retention fund. Section 2 amends article 22 of the Tax law creating a new "tax check off" on the New York State Income tax form to make it convenient to give a gift to the volunteer firefighters and volunteer emergency services recruitment and retention fund. Contributing to the fund does not reduce taxes owed to the state. FOLEY -- read twice and ordered printed, and when printed to be committed to the Committee on Investigations and Govern- ment Operations AN ACT to amend the tax law and the state finance law, in relation to establishing the volunteer firefighting and volunteer emergency services recruitment and retention fund and authorizing gifts to such fund through a state income tax check-off THE PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND ASSEM- BLY, DO ENACT AS FOLLOWS: Section 1. The tax law is amended by adding a new section 209-G to read as follows: S 209-G. GIFT FOR VOLUNTEER FIREFIGHTER AND VOLUNTEER EMERGENCY SERVICES WORKERS RECRUITMENT AND RETENTION. EFFECTIVE FOR ANY TAX YEAR COMMENCING ON OR AFTER THE EFFECTIVE DATE OF THIS SECTION, A TAXPAYER IN ANY TAXABLE YEAR MAY ELECT TO CONTRIBUTE TO THE SUPPORT OF THE VOLUNTEER FIREFIGHTER AND VOLUNTEER EMERGENCY SERVICES WORKERS RECRUITMENT AND RETENTION FUND. SUCH CONTRIBUTION SHALL BE IN ANY WHOLE DOLLAR AMOUNT AND SHALL NOT REDUCE THE AMOUNT OF THE STATE TAX OWED BY SUCH TAXPAYER. THE COMMISSIONER SHALL INCLUDE SPACE ON THE CORPORATE INCOME TAX RETURN TO ENABLE A TAXPAYER TO MAKE SUCH CONTRIBUTION. NOTWITHSTANDING ANY OTHER PROVISION OF LAW, ALL REVENUES COLLECTED PURSUANT TO THIS SECTION SHALL BE CREDITED TO THE VOLUNTEER FIREFIGHTER AND VOLUNTEER EMERGENCY SERVICES RECRUITMENT AND RETENTION FUND AND SHALL BE USED ONLY FOR THOSE PURPOSES ENUMERATED IN SECTION NINETY-NINE-Q OF THE STATE FINANCE LAW. S 2. The tax law is amended by adding a new section 630-b to read as follows: S 630-B. GIFT FOR VOLUNTEER FIREFIGHTING AND VOLUNTEER EMERGENCY SERVICES FUND. AN INDIVIDUAL IN ANY TAXABLE YEAR MAY ELECT TO CONTRIBUTE TO THE VOLUNTEER FIREFIGHTING AND VOLUNTEER EMERGENCY SERVICES FUND FOR THE RECRUITMENT AND RETENTION OF VOLUNTEER FIREFIGHTERS AND VOLUNTEER EMERGENCY SERVICES PERSONNEL.
