BILL NUMBER: S5075 TITLE OF BILL : An act to amend the environmental conservation law, in relation to establishing beverage container recycling assistance grants PURPOSE OR GENERAL IDEA OF BILL : To provide funding to assist with recycling duties under the returnable container act. SUMMARY OF SPECIFIC PROVISIONS : Creates a new section 27-1016 of the Environmental Conservation Law which would authorize the use of funding from the Environmental Protection Fund (EPF) for grants to municipalities and not-for-profit organizations to support costs associated with container recycling equipment and/or the acquisition or rehabilitation of real property or structures related to the collecting, sorting, and packaging of empty containers. This 'funding would be available upon expansion of the bottle bill and EPF as provided under Assembly bill A.2517. JUSTIFICATION : Since grocery stores and supermarkets are required by law to store and handle all recyclable bottles, storage rooms where food is kept are used to hold these items. In many cases this leads to unsanitary conditions. This fund will lighten the load placed on these businesses by providing financial assistance for the handling of the collected recyclable items in a timely fashion.

THOMPSON -- read twice and ordered printed, and when printed to be committed to the Committee on Environmental Conservation AN ACT to amend the environmental conservation law, in relation to establishing beverage container recycling assistance grants THE PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND ASSEM- BLY, DO ENACT AS FOLLOWS: Section 1. The environmental conservation law is amended by adding a new section 27-1016 to read as follows: S 27-1016. BEVERAGE CONTAINER RECYCLING ASSISTANCE GRANTS. WITHIN THE LIMITS OF APPROPRIATIONS MADE AVAILABLE PURSUANT TO SECTION NINETY-TWO-S OF THE STATE FINANCE LAW FOR MUNICIPAL RECYCLING PROJECTS OR ANY OTHER APPROPRIATION FOR SUCH PURPOSE, THE COMMISSIONER IS AUTHOR- IZED TO PROVIDE GRANTS TO MUNICIPALITIES AND NOT-FOR-PROFIT ORGANIZA- TIONS TO SUPPORT COSTS OF EQUIPMENT, AND/OR THE ACQUISITION AND/OR REHA- BILITATION OF REAL PROPERTY OR STRUCTURES RELATED TO THE COLLECTING, SORTING, AND PACKAGING OF EMPTY BEVERAGE CONTAINERS PURSUANT TO THIS TITLE. S 2. This act shall take effect on the first of January next succeed- ing the date on which it shall have become a law.
