 TITLE OF BILL :
An act to amend the county law, in relation to sewer district
extensions in the New York city watershed


 PURPOSE :
This bill would provide for certain sewer district extensions to
preserve water quality in the New York City watershed.

 SUMMARY OF SPECIFIC PROVISIONS :
Section one of the bill provides for sewer district extensions for a
limited number of properties that are under a judicial order for clean
up for causing damage to the New York City watershed water quality,
including all properties within the town of Yorktown contained within
a perimeter commencing at the intersection of Lake Road and Crow Hill
Road, proceeding northeasterly along Lake Road to its intersection
with the New Castle-Yorktown border, then proceeding southerly along
the New Castle-Yorktown border to the intersection of Crow Hill Road,
then northwesterly along Crow Hill Road to its intersection with Lake
Hill Road, the point of beginning; and all properties within the town
of New Castle contained within the perimeter commencing at the
intersection of Lake Hill Road and the New Castle-Yorktown border,
proceeding easterly along Lake Hill Road to the New Castle-Bedford
border, then proceeding southerly along the New Castle- Bedford

boarder to the New Castle-Mt. Kisco Border, then due easterly along a
straight easterly line from the intersection of the New
Castle-Bedford-Mt. Kisco border to Kisco Park Drive, then westerly
along Kisco Park Drive to Main Street, then southerly along Main
Street to Crow Hill Road, then westerly .along Crow Hill Road to the
New Castle-Yorktown border, then pines Bridge Road, then northerly
along the Yorktown-New Castle Border to the intersection with Lake
Hill Road, the point of beginning; and all properties within the town
of Bedford contained within a perimeter commencing at the intersection
of Lake Hill Road/Meeting House Road and the New Castle- Bedford
border, then proceeding easterly along Lake Hill/Meeting House Road to
Croton Kale Road, then westerly to Pine Bridges Road to the
intersection with the Bedford-New Castle border, then northwesterly
along the Bedford-New Castle border to the intersection with Lake Hill
Road/Meeting House Road, the point of beginning; and all properties
within the town of Chappaqua adjoining and along Random Farms Drive
and Random Farms Circle.

Section one of the legislation provides further that the complete
capital cost of any such extension of a sewer district shall be borne
exclusively by the county and not charged back to the owners of such
properties; provided, that such costs to be borne by the county shall
be limited to any amounts on account received from New York City for
purposes of preserving the quality of the waters of the New York City
watershed.

Section two of this bill provides for an immediate effective date.

 JUSTIFICATION :
Pursuant to a judicial order for clean up, a certain limited number of
properties that have been found to have septic system failures would
be granted the ability to correct such failure by connecting to
currently existing sewer districts which run through their
municipalities. In so doing, these properties, which geologically are
challenged to build an environmentally acceptable septic system, would
be able to comply with the judicial order to stop polluting the New
York City watershed by linking up to these existing sewer districts.
This limited number of properties are not connected with the former
County Diversion Plan.

 PRIOR LEGISLATIVE HISTORY :
A.11702/S.8646 of 2007-2008.

 FISCAL IMPLICATIONS :
The complete capital cost of any such extension of a sewer district
shall be borne exclusively by the county; provided, that such costs to
be borne by the county shall be limited to any amounts on account
received from New York City for purposes of preserving the quality of
the New York City watershed.

 EFFECTIVE DATE :
This act shall take effect immediately.

AN ACT to amend the county law, in relation to sewer district extensions
  in the New York city watershed

  THE PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND  ASSEM-
BLY, DO ENACT AS FOLLOWS:

  Section  1.  The  county law is amended by adding a new section 851 to
read as follows:
  S 851. SEWER DISTRICT EXTENSIONS  IN  THE  NEW  YORK  CITY  WATERSHED.
WHERE  ANY  COUNTY  WHICH HAS RECEIVED FUNDING FROM THE CITY OF NEW YORK
FOR THE PURPOSES OF PRESERVING THE QUALITY OF THE WATERS OF THE NEW YORK
CITY WATERSHED, IN WHICH THERE ARE ANY PROPERTIES  WITHIN  SUCH  COUNTY,
SPECIFICALLY INCLUDING ALL THAT PROPERTY OR PROPERTIES WITHIN THE COUNTY
OF  WESTCHESTER  AS  FOLLOWS: ALL PROPERTIES WITHIN THE TOWN OF YORKTOWN
CONTAINED WITHIN A PERIMETER COMMENCING AT THE INTERSECTION OF LAKE ROAD
AND CROW HILL ROAD, PROCEEDING NORTHEASTERLY  ALONG  LAKE  ROAD  TO  ITS
INTERSECTION WITH THE NEW CASTLE-YORKTOWN BORDER, THEN PROCEEDING SOUTH-
ERLY  ALONG  THE  NEW CASTLE-YORKTOWN BORDER TO THE INTERSECTION OF CROW
HILL ROAD, THEN NORTHWESTERLY ALONG CROW HILL ROAD TO  ITS  INTERSECTION
WITH  LAKE  HILL ROAD, THE POINT OF BEGINNING; AND ALL PROPERTIES WITHIN
THE TOWN OF NEW CASTLE CONTAINED WITHIN THE PERIMETER COMMENCING AT  THE
INTERSECTION  OF  LAKE  HILL  ROAD  AND  THE NEW CASTLE-YORKTOWN BORDER,
PROCEEDING EASTERLY ALONG LAKE  HILL  ROAD  TO  THE  NEW  CASTLE-BEDFORD
BORDER, THEN PROCEEDING SOUTHERLY ALONG THE NEW CASTLE-BEDFORD BORDER TO
THE  NEW  CASTLE-MT.  KISCO  BORDER,  THEN DUE WESTERLY ALONG A STRAIGHT
WESTERLY LINE FROM THE INTERSECTION OF THE NEW CASTLE-BEDFORD-MT.  KISCO
BORDER TO KISCO PARK DRIVE, THEN WESTERLY ALONG KISCO PARK DRIVE TO MAIN
STREET, THEN SOUTHERLY ALONG MAIN STREET TO CROW HILL ROAD, THEN WESTER-
LY  ALONG CROW HILL ROAD TO THE NEW CASTLE-YORKTOWN BORDER THEN PROCEED-
ING NORTHERLY ALONG THE YORKTOWN-NEW CASTLE BORDER TO  THE  INTERSECTION
WITH  LAKE  HILL ROAD, THE POINT OF BEGINNING; AND ALL PROPERTIES WITHIN

THE TOWN OF BEDFORD CONTAINED  WITHIN  A  PERIMETER  COMMENCING  AT  THE
INTERSECTION   OF   LAKE  HILL  ROAD/MEETING  HOUSE  ROAD  AND  THE  NEW
CASTLE-BEDFORD BORDER THEN PROCEEDING EASTERLY ALONG  LAKE  HILL/MEETING
HOUSE  ROAD TO CROTON LAKE ROAD THEN SOUTHERLY ON CROTON LAKE ROAD UNTIL
THE INTERSECTION OF PINE BRIDGES ROAD THEN WESTERLY ON PINE BRIDGES ROAD
TO THE INTERSECTION WITH THE BEDFORD-NEW CASTLE  BORDER  TO  THE  INTER-
SECTION  WITH LAKE HILL ROAD/MEETING HOUSE ROAD, THE POINT OF BEGINNING;
AND ALL PROPERTIES WITHIN THE TOWN  OF  CHAPPAQUA  ADJOINING  AND  ALONG
RANDOM FARMS DRIVE AND RANDOM FARMS CIRCLE; THEN SUCH COUNTY SHALL WITH-
IN ONE HUNDRED EIGHTY DAYS OF THE REQUEST OF THE OWNERS OF SUCH PROPERTY
OR  PROPERTIES,  COMMENCE THE CONSTRUCTION OF AN EXTENSION OR EXTENSIONS
OF THE SEWER DISTRICT TO WHICH THE CLOSEST POSSIBLE SEWER LINE  BELONGS,
SO  AS  TO INCLUDE SUCH PROPERTY OR PROPERTIES WITHIN SUCH DISTRICT. THE
COMPLETE CAPITAL COST OF THE  EXTENSION  OR  EXTENSIONS  OF  SUCH  SEWER
DISTRICT,  TOGETHER  WITH  ANY  NECESSARY PUMP STATIONS OR APPURTENANCES
ANCILLARY FOR ITS EFFECTIVE OPERATION SHALL BE BORNE EXCLUSIVELY BY  THE
COUNTY  AND SHALL NOT BE CHARGED BACK TO SUCH OWNERS OF SUCH PROPERTY OR
PROPERTIES; PROVIDED, HOWEVER, THAT SUCH COSTS TO BE BORNE BY THE COUNTY
SHALL BE LIMITED TO ANY AMOUNTS ON ACCOUNT RECEIVED FROM FUNDS FROM  THE
CITY  OF  NEW  YORK  FOR  THE  PURPOSES OF PRESERVING THE QUALITY OF THE
WATERS OF THE NEW YORK CITY WATERSHED. ANY SEWER  DISTRICT  TO  WHICH  A
PROPERTY  OR  PROPERTIES  ARE  CONNECTED  PURSUANT  TO  THIS SECTION MAY
COLLECT THE SAME OPERATIONAL CHARGES FROM THE OWNERS OF SUCH PROPERTY OR
PROPERTIES SO CONNECTED, AS WAS COLLECTED FROM THE OTHER  PROPERTIES  OF
THE DISTRICT PRIOR TO SUCH NEW EXTENSION.
  S 2.  This act shall take effect immediately.
