BILL NUMBER: S5717 TITLE OF BILL : An act to authorize the designated beneficiary of Kelly Story to file an application for retroactive membership in the New York state and local employees' retirement system PURPOSE : This bill would transfer Kelly Story back into New York state and local employees' retirement system (ERS) so that she can receive credit for her 14 years of service when her death benefit amount is calculated. SUMMARY OF PROVISIONS : Section I: Kelly Story, who was employed from April 25, 1994 though June 2008 as a teacher's aide at the Buffalo Central School District, shall be deemed to have been in the service upon which membership is based for the purpose of qualifying for the ordinary death benefit. Kelly Story, registration number 3747064-8, shall be eligible to receive from the New York state and local employees' retirement system such benefit payable on account of her death, by filing the appropriate paperwork on or before December 31, 2009. Section II: effective date.

STACHOWSKI -- read twice and ordered printed, and when printed to be committed to the Committee on Civil Service and Pensions AN ACT to authorize the designated beneficiary of Kelly Story to file an application for retroactive membership in the New York state and local employees' retirement system THE PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND ASSEM- BLY, DO ENACT AS FOLLOWS: Section 1. Notwithstanding any other provision of law to the contrary, Kelly Story, who was employed from April 25, 1994 through June 2008 as a teacher's aide at the Buffalo Central School District, an employer which participates in the New York state and local employees' retirement system, shall be deemed to have been in the service upon which member- ship is based for the purpose of qualifying for the ordinary death bene- fit provided by section 606 of the retirement and social security law, and the designated beneficiary of Kelly Story, registration number 3747064-8, shall be eligible to receive from the New York state and local employees' retirement system such benefit payable on account of the death of Kelly Story, by filing the appropriate application therefor with the New York state and local employees' retirement system on or before December 31, 2009. All costs incurred by implementing the provisions of this act shall be borne by the New York state and local employees' retirement system. S 2. This act shall take effect immediately. FISCAL NOTE.--This bill will deem the late Kelly A. Story's service as a Teacher's Aide with the City of Buffalo School District to be qualify- ing service for an Ordinary Death Benefit from the New York State and Local Employees' Retirement System. If this bill is enacted, we anticipate that there will be an immediate past service cost of approximately $27,400 which would be borne by the EXPLANATION--Matter in ITALICS (underscored) is new; matter in brackets [ ] is old law to be omitted.
