BILL NUMBER: S5730 TITLE OF BILL : An act to amend the criminal procedure law, in relation to designating court attendants in the village of Port Chester as peace officers PURPOSE OR GENERAL IDEA OF BILL : To allow court attendants employed in the Port Chester Court to be legally designated as Peace Officers, to best deal with security in the busiest village/town court in the State of New York. SUMMARY OF SPECIFIC PROVISIONS : Section 1 adds a new subdivision 83 to Section 2.10 of the criminal procedure law that allows court attendants in the Port Chester Village courts to serve as Peace Officers. Section 2 establishes the effective date of the act. JUSTIFICATION : The Port Chester Justice Court is the busiest village/town court in the state, and the volume of people that it serves necessitates significant security measures to insure the proper administration of justice. Conveying Peace Officer status to court attendants would advance that security, for judges, lawyers. prisoners, and the public at large.

OPPENHEIMER -- read twice and ordered printed, and when printed to be committed to the Committee on Codes AN ACT to amend the criminal procedure law, in relation to designating court attendants in the village of Port Chester as peace officers THE PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND ASSEM- BLY, DO ENACT AS FOLLOWS: Section 1. Section 2.10 of the criminal procedure law is amended by adding a new subdivision 83 to read as follows: 83. EMPLOYEES OF THE VILLAGE OF PORT CHESTER SERVING AS COURT ATTEND- ANTS AT THE VILLAGE OF PORT CHESTER COURT FACILITIES, WHEN PERFORMING THEIR DUTIES AS COURT ATTENDANTS; PROVIDED, HOWEVER, THAT NOTHING IN THIS SUBDIVISION SHALL BE DEEMED TO AUTHORIZE SUCH OFFICER TO CARRY, POSSESS, REPAIR OR DISPOSE OF A FIREARM UNLESS THE APPROPRIATE LICENSE THEREFOR HAS BEEN ISSUED PURSUANT TO SECTION 400.00 OF THE PENAL LAW.
