 TITLE OF BILL :

An act to amend the state finance law, in relation to expanding
entities that may purchase recycled or remanufactured commodities


 PURPOSE OR GENERAL IDEA OF BILL :

The act extends to local municipalities the same ability that already
exists for state agencies when purchasing recycled or remanufactured
goods.

 SUMMARY OF SPECIFIC PROVISIONS :

section 1 amends subdivision 6 of section 163 of the State Finance Law
to allow the purchase of recycled or remanufactured commodities that
are valued under $50,000 without a competitive bid process. This
ability is given to counties, cities, towns, villages, school
districts and public benefit corporations that intend to perform
financing services that will benefit the health of their citizens.

 JUSTIFICATION :

section 163 of the State Finance Law already allows state agencies to

purchase recycled and remanufactured goods under $50,000 without a
competitive bid process. This bill would extend that same ability to
local governments, school districts and public benefit companies.

For years New York state has encouraged the purchase of products that
are recycled and remanufactured to both divert thousands of tons of
waste from entering our landfill; and to support the innovative, cost
effective and growing industry of remanufacturing, which employs
thousands of people - many in small business settings. This
legislation will further promote the usage of recycled and
remanufactured products by encouraging local municipalities to
purchase these commodities using the same, simplified manner that is
already used by the state.

AN ACT to amend the state finance law, in relation to expanding entities
  that may purchase recycled or remanufactured commodities

  THE PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND  ASSEM-
BLY, DO ENACT AS FOLLOWS:

  Section  1.  Subdivision 6 of section 163 of the state finance law, as
amended by section 3 of part D of chapter 56 of the  laws  of  2006,  is
amended to read as follows:
  6. Discretionary buying thresholds. Pursuant to guidelines established
by the state procurement council: the commissioner may purchase services
and  commodities in an amount not exceeding eighty-five thousand dollars
without a  formal  competitive  process;  state  agencies  may  purchase
services  and  commodities  in  an  amount  not exceeding fifty thousand
dollars without a formal competitive process;  and  state  agencies  may
purchase  commodities  or services from small business concerns or those
certified pursuant to article fifteen-A of the executive law, or commod-
ities or technology that are recycled or remanufactured,  in  an  amount
not  exceeding one hundred thousand dollars without a formal competitive
process; AND A COUNTY, CITY, TOWN, VILLAGE, SCHOOL DISTRICT OR A  PUBLIC
BENEFIT CORPORATION PERFORMING OR FINANCING SERVICES INTENDED TO BENEFIT
THE  HEALTH  OF  CITIZENS  MAY PURCHASE COMMODITIES THAT ARE RECYCLED OR
REMANUFACTURED, IN AN AMOUNT NOT EXCEEDING FIFTY THOUSAND DOLLARS  WITH-
OUT A FORMAL COMPETITIVE PROCESS.
  S  2.  This  act shall take effect on the ninetieth day after it shall
have become a law, provided, however  that  any  rules  and  regulations
necessary  for  the  timely  implementation of this act on its effective
date shall be promulgated on or before such date; provided, further that
the amendments to section 163 of the state finance law made  by  section
one of this act shall not affect the repeal of such section and shall be
deemed repealed therewith.
