BILL NUMBER:S8415 TITLE OF BILL: An act to amend the correction law, in relation to reporting requirements of the department of correctional services PURPOSE: Legislative bill numbers S.6610-C and A.9710-D of 2010 amend the Correction Law to require that the Department of Correctional Services relay certain data to the Legislative Task Force for Demograph- ic Research and Reapportionment. The date in the legislation for the delivery of such data needed to be delayed by a few months. SUMMARY OF PROVISIONS: This chapter amendment amends the Correction Law to make technical corrections to change the date of the Department of Correctional Services reporting requirement in S.6610-C and A.9710-D from July 1 in the year in which the federal decennial census is taken to September 1, 2010. JUSTIFICATION: This legislation will provide the Department of Correc- tional Services with time necessary to deliver the data to the Task Force after the passage of the bill. LEGISLATIVE HISTORY: New Bill. FISCAL IMPLICATIONS: None. EFFECTIVE DATE: This act shall take effect on the same date as S.6610-C

S T A T E O F N E W Y O R K ________________________________________________________________________ S. 8415 A. 11597 S E N A T E - A S S E M B L Y June 29, 2010 ___________ IN SENATE -- Introduced by COMMITTEE ON RULES -- read twice and ordered printed, and when printed to be committed to the Committee on Rules IN ASSEMBLY -- Introduced by COMMITTEE ON RULES -- read once and referred to the Committee on Ways and Means AN ACT to amend the correction law, in relation to reporting require- ments of the department of correctional services THE PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND ASSEM- BLY, DO ENACT AS FOLLOWS: Section 1. The opening paragraph of paragraph (a) of subdivision 8 of section 71 of the correction law, as added by section 1 of part XX of a chapter of the laws of 2010 amending the correction law and other laws relating to the collection of census data, as proposed in legislative bill numbers S.6610-C and A.9710-D, is amended to read as follows: In each year in which the federal decennial census is taken but in which the United States bureau of the census does not implement a policy of reporting incarcerated persons at each such person's residential address prior to incarceration, the department of correctional services shall by [July] SEPTEMBER first of that same year deliver to the legis- lative task force on demographic research and reapportionment the following information for each incarcerated person subject to the juris- diction of the department and located in this state on the date for which the decennial census reports population: S 2. This act shall take effect on the same date and in the same manner as a chapter of the laws of 2010 amending the correction law and other laws relating to the collection of census data, as proposed in legislative bill numbers S.6610-C and A.9710-D, takes effect.
