MAGNARELLI, DESTITO, HOYT, PEOPLES-STOKES, SPANO, SCHROEDER, GANTT, McENENY, WRIGHT, MORELLE, REILLY, MILLMAN, CAMARA -- read once and referred to the Committee on Education AN ACT to amend the education law, in relation to establishing the "say yes to education demonstration program" THE PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND ASSEM- BLY, DO ENACT AS FOLLOWS: Section 1. The education law is amended by adding a new section 669-e to read as follows: S 669-E. SAY YES TO EDUCATION DEMONSTRATION PROGRAM. 1. THE "SAY YES TO EDUCATION DEMONSTRATION PROGRAM" IS HEREBY ESTABLISHED IN THE CITY SCHOOL DISTRICT OF THE CITY OF SYRACUSE AND IN UP TO FIVE OTHER CITIES WITH POPULATIONS OF LESS THAN ONE MILLION, AND FAMILY POVERTY RATES CALCULATED IN THE TWO THOUSAND FEDERAL CENSUS EQUAL TO OR GREATER THAN THIRTEEN PERCENT. 2. STUDENTS WHO ARE ENROLLED IN PARTICIPATING DISTRICTS PURSUANT TO SUBDIVISION ONE OF THIS SECTION AND ARE ENROLLED IN TWELFTH GRADE DURING THE TWO THOUSAND ELEVEN--TWO THOUSAND TWELVE SCHOOL YEAR, AND SUBSEQUENT YEARS THEREAFTER AND: (A) WHO HAD PREVIOUSLY BEEN ENROLLED IN SUCH DISTRICTS DURING THEIR TENTH AND ELEVENTH GRADE YEARS; (B) WHO HAVE A HIGH SCHOOL DIPLOMA OR ITS EQUIVALENT; (C) WHO ARE MATRICULATED AT THE STATE UNIVERSITY OF NEW YORK (SUNY) OR THE CITY UNIVERSITY OF NEW YORK (CUNY); AND WHO APPLY FOR FEDERAL PELL GRANTS AND THE NEW YORK STATE TUITION ASSISTANCE PROGRAM PURSUANT TO SECTION SIX HUNDRED SIXTY-SEVEN OF THIS SUBPART, AND OTHER AVAILABLE FEDERAL AND STATE AID SHALL BE ELIGIBLE FOR AWARDS PURSUANT TO SUBDIVISION THREE OF THIS SECTION. 3. ELIGIBLE STUDENTS SHALL RECEIVE AWARDS IN AN AMOUNT UP TO THE COST OF TUITION AND FEES AT SUNY AND CUNY SCHOOLS LESS OTHER STATE OR FEDERAL AWARDS RECEIVED BY SUCH STUDENTS, OR THE ACTUAL COST OF TUITION AND FEES, WHICHEVER IS LESS.
