BILL NUMBER:S2952

TITLE OF BILL:
An act
to authorize the town of Sanford, in the county of Broome, to dissolve
the Sanford fire district and establish the Sanford fire protection
district

PURPOSE:
The purpose of this bill is to dissolve the Sanford fire district and
establish the Sanford fire protection district.

SUMMARY OF PROVISIONS:
Section 1. Notwithstanding any inconsistent provision of law, the town
board of the town of Sanford may, without the receipt of a petition
pursuant to the provisions of section 185 of the Town Law and without
the necessity of the scheduling of a public hearing, adopt a
resolution dissolving the town of Sanford fire district and
establishing the town of Sanford fire protection district whose
boundaries shall be coterminous with those of town of Sanford fire
district.

Section 2. Notwithstanding section 185 of the town law or any other
inconsistent provisions of the law, upon dissolution of the Sanford
fire district in the town of Sanford, Broome County, and the creation
of the Sanford fire protection district, all fire equipment and
apparatus of the Sanford fire district shall, without consideration
therefore, be transferred to and become the property of the town of
Sanford.

Section 3. Notwithstanding any inconsistent provision of law, upon
dissolution of the town of Sanford fire district and the
establishment of the town of Sanford fire protection district any and
all cash balances and investments held by said fire district shall be
transferred to the town of Sanford. Such moneys shall be used for
payment of any remaining outstanding liabilities of the Sanford fire
district and any balance remaining after payment of such liabilities
shall be transferred to the town of Sanford. The payment and interest
on any outstanding bonds or notes issued by the Sanford fire district
shall be assumed by said town.

Section 4. Provides the effective date.

JUSTIFICATION:
Currently, the town of Sanford is faced with a problem concerning its
fire district. Per the Comptrollers recommendation the town of
Sanford requested legislation be drafted by their state officials to
abolish the town of Sanford fire district and form the town of
Sanford fire protection district.

AN ACT to authorize the town of Sanford, in the  county  of  Broome,  to
  dissolve  the  Sanford  fire  district  and establish the Sanford fire
  protection district

  THE PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND  ASSEM-
BLY, DO ENACT AS FOLLOWS:

  Section  1.  Notwithstanding any provision of law to the contrary, the
town of Sanford, in the county of Broome, acting by and through its town
board, is hereby authorized, without receipt of a petition  pursuant  to
the  provisions  of title 3 of article 17-A of the general municipal law
and without the necessity of conducting a public  hearing,  to  adopt  a
resolution dissolving the town of Sanford fire district and establishing
the  town  of  Sanford  fire protection district the boundaries of which
shall be coterminous with those of  the  former  town  of  Sanford  fire
district.

District. If a majority of the votes cast are in favor of such
proposal, the town board shall provide for the dissolution of the

Protection District.

Sanford Fire District by the town of Sanford,
in the county of Broome and
providing for the repeal
of such provisions upon expiration thereof

PURPOSE:
The purpose of this bill is to dissolve the Sanford fire district and
establish the Sanford fire protection district.

SUMMARY OF PROVISIONS:
Section 1. Notwithstanding any provision of the town law or insurance
law, all proceedings and actions taken by the town of Sanford in the
county of Broome, in relation to the abolition of the offices of
fire district commissioners of the Sanford Fire District and transfer
of their functions to the town board and town supervisor, including
executing contracts for fire protection, redistributing foreign fire
insurance premium tax funds and the establishment of any account of
funds from real property taxes of the fire district, are hereby
legalized, validated, ratified and confirmed.

Section 2. Notwithstanding the defects described in section one, to
town board of the town of Sanford is hereby authorized to initiate
proceedings pursuant to article 17-A of the general municipal law to
dissolve the Sanford Fire District as if the town board were the
governing body of the Sanford Fire District.

Section 3 makes this act take effect immediately and be deemed
repealed on July 1, 2012.
