AN ACT to authorize the town of Sanford, in the  county  of  Broome,  to
  dissolve  the  Sanford  fire  district  and establish the Sanford fire
  protection district

  THE PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND  ASSEM-
BLY, DO ENACT AS FOLLOWS:

  Section  1.  Notwithstanding any provision of law to the contrary, the
town of Sanford, in the county of Broome, acting by and through its town
board, is hereby authorized, without receipt of a petition  pursuant  to
the  provisions  of title 3 of article 17-A of the general municipal law
and without the necessity of conducting a public  hearing,  to  adopt  a
resolution dissolving the town of Sanford fire district and establishing
the  town  of  Sanford  fire protection district the boundaries of which
shall be coterminous with those of  the  former  town  of  Sanford  fire
district.
  S  2. Notwithstanding title 3 of article 17-A of the general municipal
law or any other inconsistent provisions of the law, upon dissolution of
the Sanford fire district in the town  of  Sanford,  in  the  county  of
Broome,  and  the  creation of the Sanford fire protection district, all
fire equipment and apparatus of the Sanford fire district shall, without
consideration therefor, be transferred to and become the property of the
town of Sanford.
  S 3. Notwithstanding any  inconsistent  provision  of  law,  upon  the
dissolution  of  the town of Sanford fire district and the establishment
of the town of  Sanford  fire  protection  district  any  and  all  cash
balances and investments held by said fire district shall be transferred
to  the  town  of  Sanford. Such moneys shall be used for payment of any
remaining outstanding liabilities of the Sanford fire district  and  any
balance remaining after payment of such liabilities shall be transferred
to  the  town  of  Sanford. The payment of principal and interest on any
outstanding bonds or notes issued by the Sanford fire district shall  be
assumed by said town.
  S 4. This act shall take effect immediately.

AN ACT to authorize the town of Sanford, in the  county  of  Broome,  to
  dissolve  the  Sanford  fire  district  and establish the Sanford fire
  protection district

  THE PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND  ASSEM-
BLY, DO ENACT AS FOLLOWS:

  Section  1.  Notwithstanding any provision of law to the contrary, the
town of Sanford, in the county of Broome, acting by and through its town
board, is hereby authorized, without receipt of a petition  pursuant  to
the  provisions of title 3 of article 17-A of the general municipal law,
and after conducting a public hearing thereon, to propose  a  resolution
dissolving  the  town of Sanford fire district and establishing the town
of Sanford fire protection district the boundaries  of  which  shall  be
coterminous  with  those of the former town of Sanford fire district. If
such resolution shall be adopted, the town board of the town of Sanford,
shall, not more than 45 days, nor less than 30 days, thereafter, hold  a
referendum  of  all qualified electors of such town upon the question of
whether the town of Sanford fire district shall  be  dissolved  and  the
town of Sanford fire protection district shall be established the bound-
aries  of  which  shall  be coterminous with those of the former town of
Sanford fire district. If a majority of the votes cast are in  favor  of
such  proposal,  the town board shall provide for the dissolution of the
Sanford  fire  district  and  the  establishment  of  the  Sanford  fire
protection district.
  S  2. Notwithstanding title 3 of article 17-A of the general municipal
law or any other inconsistent provisions of the law, upon dissolution of
the Sanford fire district in the town  of  Sanford,  in  the  county  of
Broome,  and  the  creation of the Sanford fire protection district, all

AN  ACT  to  legalize, validate, ratify and confirm the abolition of the
  Sanford Fire District by the town of Sanford, in the county of  Broome
  and providing for the repeal of such provisions upon expiration there-
  of

  THE  PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND ASSEM-
BLY, DO ENACT AS FOLLOWS:

  Section 1. Notwithstanding any provision of the town law or  insurance
law,  all  proceedings  and  actions taken by the town of Sanford in the
county of Broome, in relation to the abolition of the  offices  of  fire
district  commissioners  of  the  Sanford  Fire District and transfer of
their functions to the town board and town supervisor, including execut-
ing contracts for fire protection, redistributing foreign fire insurance
premium tax funds and the establishment of any  account  of  funds  from
real  property  taxes  of the fire district, are hereby legalized, vali-
dated, ratified and confirmed.
  S 2. Notwithstanding the defects described in section  one,  the  town
board   of  the  town  of  Sanford  is  hereby  authorized  to  initiate
proceedings pursuant to article 17-A of the  general  municipal  law  to
dissolve the Sanford Fire District as if the town board were the govern-
ing body of the Sanford Fire District.
  S  3.  This act shall take effect immediately; and shall expire and be
deemed repealed on July 1, 2012.
