BILL NUMBER:S4568

TITLE OF BILL:
An act
to amend the military law, in relation to the appointment of the
commander of the New York air national guard

PURPOSE OF BILL:

This bill would broaden the eligibility for appointment as commander
of the New York Air National Guard.

SUMMARY OF PROVISIONS:

Section 1 of the bill would amend Military Law § 40(3) by deleting the
words "as a pilot of service types of aircraft."

Section 2 of the bill would make it effective immediately.

EXISTING LAW:

Military Law § 40(3) provides that the New York Air National Guard
shall be commanded by a general officer who shall be federally
recognized or qualified for federal recognition in a grade not below
that of brigadier general and who has received an aeronautical rating
as a pilot of service types of aircraft.

LEGISLATIVE HISTORY:

On May 25, 2009, this proposal passed the Assembly (A.10792) by a
vote of 140-3, and was delivered to the Senate where it was referred
to the Senate Committee on Investigations and Governmental Operations
but not reported out of that Senate Committee before the end of the
2010 Legislative Session.

STATEMENT IN SUPPORT:

This bill would delete the requirement that the commander of the New
York Air National Guard be a pilot of service types of aircraft
(e.g., fixed-wing aircraft or helicopters) flown by the Air National
Guard. It would broaden eligibility for appointment as commander to
include any officer who is federally recognized or qualified for
federal recognition in a grade not below that of brigadier general
and who is authorized to wear a U.S. Air Force (USAF) aeronautical
badge ("wings") for any aeronautical rating (e.g., pilot, navigator
or air battle manager) awarded after successful completion of a USAF
military aeronautical training program. Enactment of this
legislation would give the Governor more flexibility in making an
appointment, and a larger pool of qualified, aeronautically rated
officers from which to select.

BUDGET IMPLICATIONS:
None.

EFFECTIVE DATE


This bill would take effect immediately upon enactment.

AN  ACT to amend the military law, in relation to the appointment of the
  commander of the New York air national guard

  THE PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND  ASSEM-
BLY, DO ENACT AS FOLLOWS:

  Section 1. Subdivision 3 of section 40 of the military law, as amended
by chapter 731 of the laws of 1958, is amended to read as follows:
  3.  The  New  York  air national guard shall be commanded by a general
officer who shall be  federally  recognized  or  qualified  for  federal
recognition  in a grade not below that of brigadier general, and who has
received an  aeronautical  rating  [as  a  pilot  of  service  types  of
aircraft].
  S 2. This act shall take effect immediately.
