BILL NUMBER:S4568 TITLE OF BILL: An act to amend the military law, in relation to the appointment of the commander of the New York air national guard PURPOSE OF BILL: This bill would broaden the eligibility for appointment as commander of the New York Air National Guard. SUMMARY OF PROVISIONS: Section 1 of the bill would amend Military Law § 40(3) by deleting the words "as a pilot of service types of aircraft." Section 2 of the bill would make it effective immediately. EXISTING LAW: Military Law § 40(3) provides that the New York Air National Guard shall be commanded by a general officer who shall be federally recognized or qualified for federal recognition in a grade not below that of brigadier general and who has received an aeronautical rating as a pilot of service types of aircraft.

BALL -- (at request of the Division of Military & Naval Affairs) -- read twice and ordered printed, and when printed to be committed to the Committee on Veterans, Homeland Security and Mili- tary Affairs AN ACT to amend the military law, in relation to the appointment of the commander of the New York air national guard THE PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND ASSEM- BLY, DO ENACT AS FOLLOWS: Section 1. Subdivision 3 of section 40 of the military law, as amended by chapter 731 of the laws of 1958, is amended to read as follows: 3. The New York air national guard shall be commanded by a general officer who shall be federally recognized or qualified for federal recognition in a grade not below that of brigadier general, and who has received an aeronautical rating [as a pilot of service types of aircraft].
