BILL NUMBER:S4622 TITLE OF BILL: An act to amend the public health law, in relation to records of bodies of deceased persons SUMMARY OF PROVISIONS: This bill would amend section 4212(2) of the Public Health Law to allow records of bodies of deceased persons to be maintained in book or electronic form. Section 4212(2) currently mandates that any person having lawful possession, charge, custody or control of bodies of deceased persons keep records in a bound book of information about each cadaver. REASONS FOR SUPPORT: The requirement of printed records of bodies of deceased persons (known as mortuary logs) predates the availability of electronic records. Current technology permits the use of electronic mortuary logs that are as secure and provide the same information as bound books. Electronic mortuary logs are more efficient, better for the environment, and less vulnerable to destruction and loss than printed books. The current requirement of bound mortuary logs creates a duplication of effort for offices that use electronic records as a best practice. MARCELLINO -- (at request of the NYC Office of Chief Medical Examiner) -- read twice and ordered printed, and when printed to be committed to the Committee on Health AN ACT to amend the public health law, in relation to records of bodies of deceased persons THE PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND ASSEM- BLY, DO ENACT AS FOLLOWS: Section 1. Subdivision 2 of section 4212 of the public health law, as amended by chapter 180 of the laws of 2004, is amended to read as follows: 2. It shall be the duty of the person having lawful possession, charge, custody or control of bodies of deceased persons, to keep a record in a bound book OR BY ELECTRONIC MEANS of any and all bodies of deceased persons thereafter coming into his or her possession, charge, custody or control and of the disposition made of said bodies, showing (a) the name of the deceased person, if known, (b) the dates of death and burial or other lawful disposition, if known, (c) the names and places of residence of relatives of the deceased person, if known, (d) the name of the person who claimed the body of the deceased person for interment or other lawful disposition, (e) the name of the university, college, school or institute to whom the body of the deceased person was delivered or released, and (f) the opposition of the deceased to the dissection or autopsy of his or her body as indicated by an identifica- tion card carried upon his or her person. This record book OR ELECTRONIC RECORD shall be open to the inspection of the officers and agents of universities, colleges, schools or institutes entitled to receive bodies of deceased persons. S2.
