BILL NUMBER:S5508

TITLE OF BILL:
An act
to amend the education law, in relation to accessing student's
individualized education programs electronically

PURPOSE OR GENERAL IDEA OF BILL:
This bill would give the school district the option of enabling a
teacher to have access to a student's individual education program
(IEP) electronically.

SUMMARY OF SPECIFIC PROVISIONS:
Paragraph a of subdivision 7 of section 4022 of the education law is
amended to give the school district the option to enable a teacher to
have access to their student's individual education program
electronically.

Section 2 makes this act effective immediately.

JUSTIFICATION:
This bill will provide much needed mandate relief to the NYC DOE of
approximately $3 million dollars annually in printing costs alone. It
will also save time, promote environmental conservation, and provide
better protection for the confidentiality of student records than the
existing system, which causes multiple copies of records to be in
circulation.
Concomitantly, it ensures that teachers continue to have easy access
to their students' IEP and continue to be informed of their
responsibilities under the IEP.

FISCAL IMPLICATIONS:
None to the State.
Savings of approximately $3 million dollars to the NYC DOE.

EFFECTIVE DATE:
Immediately.

AN ACT to amend the education law, in relation  to  accessing  student's
  individualized education programs electronically

  THE  PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND ASSEM-
BLY, DO ENACT AS FOLLOWS:

  Section 1. Paragraph a of subdivision 7 of section 4402 of the  educa-
tion  law,  as  added  by chapter 408 of the laws of 2002, is amended to
read as follows:
  a. The board of education or trustees of each school district and  the
board  of trustees of each charter school shall adopt a policy to ensure
that each regular education teacher, special education teacher,  related
service  provider, and other service provider who is responsible for the
implementation of a student's individualized education program shall  be
given a copy of such student's individualized education program OR SHALL
BE  ABLE TO ACCESS SUCH STUDENT'S INDIVIDUALIZED EDUCATION PROGRAM ELEC-
TRONICALLY prior to the implementation of such program.
  S 2. This act shall take effect immediately.

STUDENT'S INDIVIDUALIZED EDUCATION PROGRAM SHALL BE NOTIFIED AND TRAINED
ON HOW TO ACCESS SUCH INDIVIDUALIZED EDUCATION PROGRAMS ELECTRONICALLY.
  S 2. This act shall take effect immediately.
