TITLE OF BILL:
An act
to amend chapter 433 of the laws of 1996 relating to creating the
Wallkill public library district in the town of Shawangunk, Ulster
county, in relation to the number of trustees of such district

PURPOSE:
This bill would establish that the number of members managing and
controlling the board of trustees is to consist of seven to eleven
members, as the board deems necessary.

SUMMARY OF PROVISIONS:
Section 1. Amends paragraph (c) of subdivision 1 of section 2 of the
chapter 433 of the laws of 1996 relating to creating the Wallkill
public library district in the town of Shawangunk, Ulster county, to
provide for the election of at least seven but no more than eleven
trustees.

Section 2. Amends section 3 of chapter 433 of the laws of 1996
relating to creating the Wallkill public library district in the town
of Shawangunk, Ulster county, to provide for the management of the
district by a board of trustees consisting of at least seven but no
more than eleven members.

Section 3. Effective Date.

JUSTIFICATION:
The Wallkill Public Library has requested this amendment to their
charter as they feel that seven trustees can adequately govern its
current district size as opposed to the eleven currently required by
their charter. This legislation provides the board with the option to
expand the number of members up to eleven individuals, if deemed
necessary, to fit the needs of special projects.

EFFECTIVE DATE:
This act shall take effect immediately.

AN ACT to amend chapter 433 of the laws of 1996 relating to creating the
  Wallkill public library district in the  town  of  Shawangunk,  Ulster
  county, in relation to the number of trustees of such district

  THE  PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND ASSEM-
BLY, DO ENACT AS FOLLOWS:

  Section 1. Paragraph (c) of subdivision 1 of section 2 of chapter  433
of  the  laws  of  1996 relating to creating the Wallkill public library
district in the town of Shawangunk, Ulster county, is amended to read as
follows:
  (c) the election of AT LEAST SEVEN BUT NO MORE THAN eleven trustees as
herein provided.
  S 2. Section 3 of chapter 433 of the laws of 1996 relating to creating
the Wallkill public library district in the town of  Shawangunk,  Ulster
county, is amended to read as follows:
  S  3. Organization and structure. The Wallkill public library district
shall be managed,  operated  and  controlled  by  a  board  of  trustees
consisting  of  AT  LEAST  SEVEN  BUT NO MORE THAN eleven members. These
trustees shall at the first regular meeting of the  board  determine  by
lot  the  year  in  which each of their terms of office expires, and the
terms shall expire as follows: After one year: one  trustee;  after  two
years:  two  trustees;  after  three years:   three trustees; after four
years: three trustees; and after five years:  two trustees. As vacancies
occur, trustees shall be elected at the annual election herein  provided
for  to  serve for five year terms by the voters of the library district
thereby created, said terms to commence on the  first  day  of  December
next  following  the  election.  Only persons living within the Wallkill
school district shall be eligible for election to the board of trustees.
The board of trustees at its first meeting  each  year  shall  elect  or
appoint a president and vice-president who shall be members of the board
and a clerk, treasurer, and such other officers as they deem necessary.
  S 3. This act shall take effect immediately.

A MAJORITY OF THE BOARD MAY,  BY  RESOLUTION,  REDUCE  OR  INCREASE  THE
NUMBER  OF  TRUSTEES  PURSUANT  TO  THIS  ACT.  SUCH RESOLUTION SHALL BE
PASSED,  IF AT ALL, NOT LESS THAN THIRTY NOR MORE THAN NINETY DAYS PRIOR
TO THE FIRST DAY OF SIGNING ANY PETITION TO BE NOMINATED FOR ELECTION AS
A TRUSTEE. NO REDUCTION BY RESOLUTION IN THE NUMBER  OF  TRUSTEES  SHALL
CREATE A VACANCY EXCEPT UPON EXPIRATION OF THE EXISTING TERM.
  S 3. This act shall take effect immediately.
