BILL NUMBER:S6340

TITLE OF BILL:
An act
in relation to legalizing, validating, ratifying and confirming certain
acts and proceedings of the Hunter-Tannersville Central School District
with respect to certain transportation contracts

PURPOSE:
To allow transportation aid to be paid to the
Hunter-Tannersville Central School District despite an error in the
required bid opening time period

SUMMARY OF PROVISIONS:
The bill would legalize, validate and ratify a
transportation contract entered into by the Hunter-Tannersville
Central School District notwithstanding any failure to comply with
certain bidding requirements and would direct the state education
department (SED) to consider such contracts valid and proper
obligations of the Hunter-Tannersville Central School District.

EXISTING LAW:
Current law requires five days between publication of
the advertisement for bids and the opening of the bids.

JUSTIFICATION:
The bill permits the Hunter-Tannersville Central School
District in Greene County to be receive state aid for certain
transportation contracts which the district entered into in 2011. Due
to an inadvertent error and the publication of a bid notice one day
later than planned, the required five days did not elapse between the
first publication of the advertisement for bids and the opening and
reading of the bids. Despite the unintentional error, it is important
to the district to receive the transportation aid so as to ensure
that sufficient funding is available to support the safety and
educational needs of the school children of the district. The
district should not lose its transportation reimbursement for the
contract due to a one-day lapse in the publication of its bid notice.

LEGISLATIVE HISTORY:
New bill.

FISCAL IMPLICATIONS:
Funding is available within the state's transportation
categorical aid.

EFFECTIVE DATE:
Immediate.
