BILL NUMBER:S6340 TITLE OF BILL: An act in relation to legalizing, validating, ratifying and confirming certain acts and proceedings of the Hunter-Tannersville Central School District with respect to certain transportation contracts PURPOSE: To allow transportation aid to be paid to the Hunter-Tannersville Central School District despite an error in the required bid opening time period SUMMARY OF PROVISIONS: The bill would legalize, validate and ratify a transportation contract entered into by the Hunter-Tannersville Central School District notwithstanding any failure to comply with certain bidding requirements and would direct the state education department (SED) to consider such contracts valid and proper obligations of the Hunter-Tannersville Central School District. EXISTING LAW: Current law requires five days between publication of the advertisement for bids and the opening of the bids. JUSTIFICATION:

SEWARD -- read twice and ordered printed, and when printed to be committed to the Committee on Education AN ACT in relation to legalizing, validating, ratifying and confirming certain acts and proceedings of the Hunter-Tannersville Central School District with respect to certain transportation contracts THE PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND ASSEM- BLY, DO ENACT AS FOLLOWS: Section 1. All the acts done and proceedings heretofore had and taken or caused to be had and taken by the Hunter-Tannersville Central School District and by all officers, employees or agents of such school district relating to or in connection with certain transportation contracts of the 2011-2012 school year with various contractors, and all acts incidental thereto are hereby legalized, validated, ratified and confirmed, notwithstanding any failure to comply with the contract award, approval, categorizing and filing provisions of the education law, general municipal law or any other law or any other statutory authority, rule or regulation, other than the filing provisions contained in paragraph a of subdivision 5 of section 3604 of the educa- tion law, in relation to any omission, error, defect, irregularity or illegality in such acts done and proceedings had and taken. S 2. The education department is hereby directed to consider the aforementioned contracts for transportation aid as valid and proper obligations of the Hunter-Tannersville Central School District.
