BILL NUMBER:S7475 TITLE OF BILL: An act to amend chapter 24 of the laws of 2007 constituting Jonathan's law, in relation to the effectiveness thereof PURPOSE: The purpose of this bill is to ensure the intended implementation of the provisions of Chapter 321 of the Laws of 2008 governing the release of certain records to qualified persons. SUMMARY OF PROVISIONS: This bill amends section 11 of chapter 24 of the laws of 2007, constituting Jonathan's Law, allowing requests for release of records under Jonathan's Law for incidents on or after January 1, 2003, to be submitted at anytime. EXISTING LAW: Chapter 24 of the laws of 2007. JUSTIFICATION: This legislation to remove the deadline for parents and/or qualified persons to obtain records and documents pertaining to investigations into the abuse and mistreatment of their children and to allow them to request record at anytime.

McDONALD -- read twice and ordered printed, and when printed to be committed to the Committee on Mental Health and Develop- mental Disabilities AN ACT to amend chapter 24 of the laws of 2007 constituting Jonathan's law, in relation to the effectiveness thereof THE PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND ASSEM- BLY, DO ENACT AS FOLLOWS: Section 1. Section 11 of chapter 24 of the laws of 2007, constituting Jonathan's law, as amended by chapter 262 of the laws of 2010, is amended to read as follows: S 11. This act shall take effect immediately; provided, however, that section 33.25 of the mental hygiene law as added by section two of this act shall be deemed to have been in full force and effect on and after January 1, 2003 with respect to any written requests submitted by quali- fied persons [on or before December 31, 2012]. S 2. This act shall take effect immediately. EXPLANATION--Matter in ITALICS (underscored) is new; matter in brackets [ ] is old law to be omitted. LBD14691-01-2
