AN ACT approving the exchange of certain lands between National Grid and
  the People of the State of New York

  THE  PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND ASSEM-
BLY, DO ENACT AS FOLLOWS:

  Section 1.  Pursuant to section 1 of article 14 of the state constitu-
tion, as amended at the general election held  in  November,  2009,  the
legislature  approves the lands to be exchanged as specified in this act
and finds and determines that the property to be received by the  state,
described in section four of this act, is true and forest land and is at
least equal in value to the land conveyed by the state to National Grid,
described  in  section  five  of this act. The legislature further finds
that all provisions and requirements of  the  constitution  relating  to
this exchange have been met.
  S  2. The commissioner of general services, after certification to him
or her by the commissioner of environmental conservation that  title  to
the lands described in section four of this act has vested in the people
of the state of New York, shall issue letters patent to National Grid of
the lands described in section five of this act.
  Notwithstanding the provisions of the public lands law, the conveyance
by  the  state  may be without reservation of any minerals.  The letters
patent shall contain the following covenants and restrictions:
  (a) The property shall be used as a utility corridor and for no  other
purpose.
  (b)  National Grid shall not sell, transfer or subdivide the property,
except for the sale or transfer of the  property  to  any  affiliate  or
subsidiary of National Grid or a person or entity utilizing the property
for  similar/utility/communications  purposes  or  succeeding  to all or
substantially all of the assets of National Grid.

  S 3. Title to the land described in section four shall be approved  by
the  Attorney  General,  and  the deed to the people of the state of New
York of such lands shall be approved by the Attorney General as to  form
and  manner  of execution and recordability prior to its delivery to the
St. Lawrence County Clerk for recording.
  S 4. The LAND CONVEYED TO THE STATE IS DESCRIBED AS FOLLOWS:
                               12.69 Acres
  ALL  THAT  TRACT  OR  PARCEL OF LAND situate in Lots D & G, Township 6
(Childwold), Macomb's Purchase, Great Tract No. 2, Town of  Piercefield,
St. Lawrence County, New York, bounded and described as follows:
  Commencing  at  a point marked by a 4" iron pipe & stones at the divi-
sion line between the Towns of Piercefield and Colton, said point  mark-
ing  the southwesterly corner of lands of the People of the State of New
York recorded as Document No.  1999-9532  at  the  St.  Lawrence  County
Clerk's  Office;  thence  N  83°-43'-58"  E,  2840.84' to a point on the
westerly line of a 150' wide strip of land owned by Niagara Mohawk Power
Corporation (520/11), and the Point of Beginning of the parcel  of  land
to  be  described; thence along the west side of said 150' wide strip of
land and lands of the People of the State of New York N 26°- 56'  -  34"
W, 2283.05' to a point at the intersection of lands of Timbervest TVP II
New  York  LLC  (2008-6766)  and Lands of the People of the State of New
York (1999-9533); thence through said 150' wide strip of land  S  72°  -
44'  -  26"  E,  209.27' to a point at the east side of said strip, said
point also being at the intersection of lands of Timbervest TVP  II  New
York  LLC  (2008-6766)  and  Lands  of  the People of the New York State
(1999-9533); thence S 26° - 56' - 34" E, 3622.66' along the east side of
said 150' wide strip and along lands of the People of the State  of  New
York  to a point at the intersection of Lands of Lyme Adirondack Timber-
land I (2006-15364) and Lands of the People of the  State  of  New  York
(1999-9532);  thence  through said 150' wide strip of land S 70° - 20' -
41" W, 151.25' to a point on the west side of  said  strip,  said  point
being  at  the  intersection  of  Lands  of Lyme Adirondack Timberland I
(2006-15364)  and  Lands  of  the  People  of  the  State  of  New  York
(1999-9532);  thence  along the west side of said 150' strip of land and
Lands of the People of the State of New York  N  26°  -  56'  -  34"  W,
1466.33' to the point of beginning.
  All  above  said  bearings  are referenced to the New York State Plane
Coordinate System, Eastern Zone, NAD 83 and all above said distances are
horizontal ground distances.
  The above described parcel containing 12.69  acres  of  land  more  or
less,  as  shown on NYSDEC Map No. 12,189 prepared for the Department of
Environmental Conservation by James M.  Zuccolotto,  NYSPLS  No.  49832,
copies  of  said  map dated December 1, 2010 being filed at the New York
State Department of Environmental Conservation Offices in Watertown  and
Albany.  The  above  said  NYSDEC Map No. 12,189 was recorded in the St.
Lawrence  County  Clerk's  office  on   December   9,   2010   in   File
R-2010-00018586.
  Being  a  portion  of a parcel acquired by Niagara Mohawk Power Corpo-
ration by a corporate merger between Niagara  Mohawk  Power  Corporation
and Paul Smith's Electric Light and Power and Railroad Company, recorded
in the St. Lawrence County Clerk's Office on January 27, 1966 in Book #2
of  the Register of Corporations at No. 2404. Prior to said merger, Paul
Smith's Electric Light and Power  and  Railroad  Company  acquired  said
parcel  from  Eastern New York Power Corporation by deed dated September
17, 1953 and recorded in the  St.  Lawrence  County  Clerk's  Office  on
September  21, 1953 in Liber 520 of Deeds, Page 11. Following said merg-

er, Niagara Mohawk Power Corporation reserved a 150' wide strip of  land
for  the  Piercefield-Tupper  Lake  Transmission Line in a conveyance to
Paul Smith's College of Arts and Sciences by  deed  dated  December  29,
1969  and recorded in the St. Lawrence County Clerk's Office on February
18, 1970 in Book 834 of  Deeds,  Page  115.  Intending  to  convey  that
portion  of  the  above  referenced  150'  wide strip passing within and
running through the  State  lands  along  the  Raquette  River  Corridor
(1999-9532  & 1999-9533) as shown on NYSDEC Map No. 11,377, Sheet 2 of 5
Sheets prepared for the  New  York  State  Department  of  Environmental
Conservation  by  Thomas J. Kovoch, NYSPLS No. 49092, copies of said map
being filed at the New York State Department of Environmental  Conserva-
tion Offices in Watertown and Albany.
  Excepting  and  Reserving  to  Niagara  Mohawk  Power Corporation, DBA
National Grid an easement for ingress and egress over a 25'  wide  strip
of  land  over  the west side of the above described lands for access to
and from a remaining portion of the 150' wide strip lands located  north
of  the  Raquette  River  not being conveyed to the State of New York by
this exchange and containing 1.05 acres of land more or less;  said  25'
wide access for ingress and egress to be extinguished if/when said lands
north of the Raquette River are conveyed and combined with the adjoining
lands  which  are  now  or formerly owned by Timbervest TVP II New York,
LLC.
                               7.18 Acres
  ALL THAT TRACT OR PARCEL OF LAND situate in Lots H  &  K,  Township  6
(Childwold),  Macomb's Purchase, Great Tract No. 2, Town of Piercefield,
St. Lawrence County, New York, bounded and described as follows:
  Commencing at a point marked by a 4" iron pipe & stones at  the  divi-

  Excepting  and  reserving  to  Niagara  Mohawk  Power Corporation, DBA
National Grid an easement for ingress and egress over a 25'  wide  strip
of  land  over  the west side of the above described lands for access to
and from a remaining portion of the 150' wide  strip  of  lands  located
north of the above said parcel and north of the Raquette River which are
not  being  conveyed  to  the  State  of  New  York by this exchange and
containing 2.15 acres of land more or less; said 25' wide  access  strip
for  ingress  and  egress to be extinguished if/when said lands north of
the Raquette River are conveyed and combined with  the  adjoining  lands
which  are  now or formerly owned by Timbervest TVP II New York, LLC and
if/when said strip lands are conveyed and combined with adjoining  lands
which  are now or formerly owned by Lyme Adirondack Timberland I for the
remaining strip located between the Raquette  River  and  north  of  the
above described 7.18 acre parcel.

Power Corporation for the Townline-Piercefield #32 Electric Transmission
line, bounded and described as follows:
  Commencing  at  a  3"  iron pipe filled with concrete on the northerly
line of Lot 1; Thence S 83° 50' 56" W, 349.80 feet along said  northerly
line to the Point of Beginning; Thence S 11° 51' 13" E, 262.31 feet to a
point;  Thence S 01° 43' 50" E, 287.87 feet to a point; Thence S 01° 55'

line of said Lot 2 to a point on the Westerly highway  boundary  of  New

running  along  Jamestown Falls Access Road that runs through Parcel "C"
and is located approximately 1045 feet southeasterly from the  northerly
bounds  of  the  above  described Parcel "C". The easement is for Public
Access that includes Motor Vehicle Use  and  Administrative  Maintenance

Mohawk Power Corporation for the Townline-Piercefield #32 Electric Tran-
smission line, bounded and described as follows:
  Commencing at a 4" iron pipe filled with concrete at the Southwesterly
corner of Lot 5; Thence N 07° 30' 57" W, 3841.98 feet along the Westerly
line of said Lot 5 to the easterly highway boundary of  New  York  State
Route #56 and the Point of Beginning; Thence along said easterly highway
