TITLE OF BILL:
An act to authorize the commissioner of general services to transfer and
convey certain land to the Thiells-Roseville fire district

PURPOSE:
The  purpose  of the bill is to allow for the Office of General Services
(OGS) to transfer lands owned by Office for  People  with  Developmental
Disabilities (OPWDD) to the Thiells-Roseville Fire District.

SUMMARY OF PROVISIONS:
Section  1. Authorizes the Commissioner of OGS to transfer and convey to
the Thiells-Roseville Fire District approximately 1.2 acres of land that
is currently owned by OPWDD.

Section 2. Describes the 1.2 acres of land that is to be transferred and
conveyed to Thiells-Roseville Fire District.

Section 3. This section states that the description in section 2 is  not
intended to be a legal description but rather to identify the land to be
conveyed. The Thiells-Roseville Fire District must submit to the Commis-
sioner of OGS an accurate survey and description of the land.

Section  4.  Thiells-Roseville  Fire  District  has  one year to make an
application for conveyance of the land.

section 5. States that the lands can only be used  exclusively  for  the
purpose  of  the  Thiells-Roseville  Fire District to... and upon termi-
nation of such use the title to the lands will revert back to the  State
of New York.

Section 6. This act shall take effect immediately.

JUSTIFICATION:
The  Hamlet of Thiells, in the Town of Haverstraw, has seen a population
growth over the past several years and, as a result, the  community  has
continued  to  expand. Due to the growth in the population, the Thiells-
Roseville Fire District has had to serve a much larger  community  which
is  why  the  fire  district  has  enlisted and continues to enlist more
volunteer firefighters. As  such,  the  current  fire  district  station
cannot  adequately meet the needs of the increasing number of firefight-
ers. Therefore, in order to accommodate the growing community and  grow-
ing  number of fire fighters needed for the safety of the community, the
district would like to expand its facilities. This land conveyance  will
allow  the  fire district to construct a new substation which would meet
the needs of the community for the next 25-50 years.

AN ACT to authorize the commissioner of general services to transfer and
  convey certain land to the Thiells-Roseville fire district

  THE PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND  ASSEM-
BLY, DO ENACT AS FOLLOWS:

  Section  1.  Subject to provisions of this act but notwithstanding any
other provision of law to the  contrary,  the  commissioner  of  general
services  is  hereby  authorized  to transfer and convey to the Thiells-
Roseville Fire District in consideration of one  dollar  and  upon  such
other  conditions as the commissioner may deem proper, approximately 1.2
acres of that land that were  part  of  the  former  Letchworth  Village
Hospital  and  is owned by the Office of People with Developmental Disa-
bilities.
  S 2. The lands authorized by this act to be transferred  and  conveyed
are as follows:
  ALL  that  certain  piece  or parcel of land, situate in the Hamlet of
Thiells, in the Town of Haverstraw, County of  Rockland,  State  of  New
York, being more particularly bound and described as follows:
The  parcel  is  approximately  1.2  acres and lies on the southeasterly
corner of that land known and described as Section  19.16  Block  1  and
part  of  lot  14  on  the  Town  of  Haverstraw  Tax Map. The parcel is
described as follows: running approximately from a "rebar  set"  in  the
southeasterly corner of the aforementioned property running in southwes-
terly direction approximately 185 feet running thence in a northwesterly
direction  approximately  289  feet  running  thence  in a northeasterly
direction 185.07 feet and running thence in  a  northeasterly  direction
289.62 feet to the point or place of the beginning.
  S  3.  The  description  in  section two of this act of the land to be
conveyed is not intended to be a legal description but  is  intended  to
identify  the parcel to be conveyed. As a condition of the purchase, the
Thiells-Roseville Fire District shall  submit  to  the  commissioner  of
general  services,  for  his  or  her  approval,  an accurate survey and

description of the lands to be  conveyed,  which  may  be  used  in  the
conveyance thereof.
  S  4.  The office of general services shall not transfer or convey the
aforesaid land unless application  is  made  by  Thiells-Roseville  Fire
District within 1 year after the effective date of this act.
  S  5.  Any lands transferred pursuant to this act shall be used exclu-
sively for the  purposes  of  the  Thiells-Roseville  Fire  District  to
construct  a  fire  district substation and upon termination of such use
title to the lands so transferred shall revert to the State of New York.
  S 6. This act shall take effect immediately.
