S T A T E O F N E W Y O R K ________________________________________________________________________ 9367 I N A S S E M B L Y April 23, 2014 ___________ Introduced by M. of A. ABBATE -- read once and referred to the Committee on Governmental Employees AN ACT to amend the civil service law, in relation to employment of persons with disabilities by municipalities THE PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND ASSEM- BLY, DO ENACT AS FOLLOWS: Section 1. Section 55-a of the civil service law is amended by adding a new subdivision 5 to read as follows: 5. NOTWITHSTANDING ANY OTHER PROVISION OF LAW, A MUNICIPAL COMMISSION SHALL TREAT EMPLOYEES APPOINTED PURSUANT TO THE PROVISIONS OF THIS SECTION, WHO ARE HOLDING OR WHO HAVE HELD A POSITION IN THE NON-COMPETI- TIVE CLASS, AS IF THEY WERE EMPLOYEES IN THE COMPETITIVE CLASS WHERE, BECAUSE OF ECONOMY, CONSOLIDATION, OR ABOLITION OF FUNCTIONS, CURTAIL- MENT OF ACTIVITIES OR OTHERWISE, A NUMBER OF SUCH POSITIONS IN EITHER THE NON-COMPETITIVE OR COMPETITIVE CLASSES ARE ABOLISHED OR REDUCED IN RANK OR SALARY GRADE, SUSPENSION OR DEMOTION, AS FURTHER PROVIDED IN TITLE C OF ARTICLE FIVE OF THIS CHAPTER. FOR PURPOSES OF SENIORITY, THE DATE AN EMPLOYEE IS APPOINTED PURSUANT TO THIS SECTION, SHALL BE DEEMED EQUIVALENT TO THE DATE A COMPETITIVE EMPLOYEE IS APPOINTED FROM AN ELIGIBLE LIST. S 2.
