S T A T E O F N E W Y O R K ________________________________________________________________________ 9732 I N A S S E M B L Y May 20, 2014 ___________ Introduced by M. of A. LUPARDO -- (at request of the Office of Court Administration) -- read once and referred to the Committee on Children and Families AN ACT to amend the social services law, in relation to consents to medical treatment for destitute children placed in foster care by the family court THE PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND ASSEM- BLY, DO ENACT AS FOLLOWS: Section 1. Section 383-b of the social services law, as amended by chapter 570 of the laws of 1986, is amended to read as follows: S 383-b. Medical treatment for abused [or], neglected AND DESTITUTE children; consent of commissioners. The local commissioner of social services or the local commissioner of health may give effective consent for medical, dental, health and hospital services for any child who has been found by the family court to be an abused [child or a], neglected OR DESTITUTE child, or who has been taken into or kept in protective custody or removed from the place where he OR SHE is residing, or who has been placed in the custody of such commissioner, pursuant to section four hundred seventeen of this [chapter] ARTICLE or section one thousand twenty-two, section one thousand twenty-four [or], section one thousand twenty-seven, SECTION ONE THOUSAND NINETY-FOUR OR SECTION ONE THOUSAND NINETY-FIVE of the family court act.
