BILL NUMBER:S1696 TITLE OF BILL: An act to amend the real property tax law, in relation to providing an enhanced exemption for veterans regardless of income SUMMARY OF PROVISIONS: Section 1: amends subdivision 4 of section 425 of the Real Property Tax Law as added by section 2 of part A of Chapter 56 of the Laws of 1998 by adding a new subparagraph (vii) providing that combat veterans, shall qualify for the enhanced STAR exemption without consideration of income. PURPOSE AND JUSTIFICATION: With this bill, all senior combat veterans would be eligible for the enhanced STAR exemption on their homes. Combat veterans are currently entitled to receive a veteran's exemption for town and county taxes, but not for school taxes. This bill offers further recognition of the sacrifices that combat veterans made while serving. in our military during times of war. PRIOR LEGISLATIVE HISTORY: 2010 - S.5848 -- VETERANS 2011-2012 - S3227/A.10111 -- FINANCE/Veterans' Affairs FISCAL IMPLICATIONS: To be determined. EFFECTIVE DATE: This act shall take effect on the first of January next succeeding the date date upon which it becomes law.

Paragraph (b) of subdivision 4 of section 425 of the real property tax law is amended by adding a new subparagraph (vii) to read as follows: (VII) NOTWITHSTANDING ANY OTHER PROVISION OF THIS PARAGRAPH, ANY VETERAN, AS DEFINED IN PARAGRAPH (E) OF SUBDIVISION ONE OF SECTION FOUR HUNDRED FIFTY-EIGHT-A OF THIS TITLE, SHALL QUALIFY FOR THE ENHANCED EXEMPTION PROVIDED BY THIS SECTION. S 2. This act shall take effect on the first of January next succeed- ing the date on which it shall have become a law.
