TITLE OF BILL:
An act
to amend the social services law, in relation to parents and caretakers
who work a late shift
PURPOSE OF GENERAL IDEA OF BILL:
The purpose of this bill is to provide for parents and caretakers who
are otherwise eligible, a child care subsidy when care is necessary to
enable them to get an adequate night's rest.
SUMMARY OF SPECIFIC PROVISIONS:
Amends Section 410-W of the social services law to allow parents and
caretakers who are otherwise eligible for a child care subsidy to
receive a subsidy when care is necessary to enable them to sleep (for
eight hours) because they work a late shift and have a child who is
under the age of six and not in school for a full day.
JUSTIFICATION:
Parents who work nights often need child care so that they can sleep
during the day if their children are young and not in school.
Regulations currently permit, but do not require social services
districts to provide a child care subsidy to financially eligible
parents and caretakers whiz, work second or third shifts and need
child care for their young children in order to sleep.

AN ACT to amend the social services law, in relation to parents and
caretakers who work a late shift
THE PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND ASSEM-
BLY, DO ENACT AS FOLLOWS:
Section 1. Section 410-w of the social services law is amended by
adding a new subdivision 7 to read as follows:
7. PARENTS AND CARETAKERS WHO ARE OTHERWISE ELIGIBLE FOR A CHILD CARE
SUBSIDY SHALL RECEIVE A SUBSIDY WHEN CARE IS NECESSARY TO ENABLE THEM TO
SLEEP BECAUSE THEY WORK A LATE SHIFT AND HAVE A CHILD WHO IS UNDER THE
AGE OF SIX AND NOT IN SCHOOL FOR A FULL SCHOOL DAY. THE AUTHORIZATION
FOR A SUBSIDY SHALL BE SUFFICIENT TO ALLOW THE PARENT TO OBTAIN EIGHT
HOURS OF SLEEP.
S 2. This act shall take effect immediately.

AN ACT to amend the social services law, in relation to child care
services for parents and caretakers who work a late shift
THE PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND ASSEM-
BLY, DO ENACT AS FOLLOWS:
Section 1. The opening paragraph of subdivision 1 of section 410-x of
the social services law is designated paragraph (a) and a new paragraph
(b) is added to read as follows:
(B) THE CHILD CARE SERVICES PROVIDED MUST BE REASONABLY RELATED TO THE
HOURS OF EMPLOYMENT, EDUCATION OR TRAINING OF A CHILD'S CARETAKER, AS
APPLICABLE, AND PERMIT TIME FOR DELIVERY AND PICK-UP OF THE CHILD, AND
PROVIDE UP TO EIGHT HOURS OF CHILD CARE SERVICES, IF NEEDED, TO ENABLE
AN EMPLOYED CARETAKER WHO WORKS A SECOND OR THIRD SHIFT TO SLEEP. SUCH
SERVICES MUST BE INCLUDED IN THE SOCIAL SERVICES DISTRICT CHILD CARE
SERVICES PLAN AS PART OF ITS CONSOLIDATED SERVICES PLAN OR INTEGRATED
COUNTY PLAN.
S 2. This act shall take effect immediately.
