BILL NUMBER:S5322 TITLE OF BILL: An act to amend the education law and the general municipal law, in relation to plumbing and electrical work performed on school buildings PURPOSE OR GENERAL IDEA OF THE BILL: The purpose of this bill is to ensure electrical and plumbing work done on school buildings is performed by licensed professionals if required by a local municipality. SUMMARY OF PROVISIONS: This bill adds a new section to Education Law, and amends the General Municipal Law, to require all plumbing and electrical work that is to be performed on any school building or appurtenant facility be completed by a licensed plumber or licensed electrician if required by the local municipality where the building or facility is located. JUSTIFICATION: Electrical and plumbing Projects are expensive and have the potential to be dangerous if performed incorrectly. if the work is not done properly, it may cause harm to the students, school personnel, and the building itself. This legislation would ensure that any electrical cr plumbing work done to school buildings is carried out by licensed Professionals if required by the local municipality. This will save school districts

FLANAGAN -- read twice and ordered printed, and when printed to be committed to the Committee on Education AN ACT to amend the education law and the general municipal law, in relation to plumbing and electrical work performed on school buildings THE PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND ASSEM- BLY, DO ENACT AS FOLLOWS: Section 1. The education law is amended by adding a new section 408-c to read as follows: S 408-C. PLUMBING AND ELECTRICAL WORK. ALL PLUMBING AND ELECTRICAL WORK PERFORMED BY AN INDEPENDENT CONTRACTOR OR FIRM ON ANY SCHOOL BUILD- ING OR APPURTENANT FACILITIES SHALL BE PERFORMED BY A LICENSED PLUMBER OR LICENSED ELECTRICIAN AS APPROPRIATE, IF REQUIRED BY A LOCAL MUNICI- PALITY WHERE THE BUILDING OR FACILITY IS LOCATED. SUCH LICENSED PLUMBER OR LICENSED ELECTRICIAN SHALL PROVIDE A COPY OF HIS OR HER VALID LICENSE PRIOR TO COMMENCEMENT OF THE WORK DESIGNATED IN THE BID IF A LICENSE IS REQUIRED BY A LOCAL MUNICIPALITY WHERE THE BUILDING OR FACILITY IS LOCATED OR, IF IT IS UNDER THE THRESHOLD REQUIRED PURSUANT TO SECTION ONE HUNDRED ONE OF THE GENERAL MUNICIPAL LAW, THEN THE GENERAL CONTRAC- TOR SHALL SUBMIT A COPY OF THE REQUIRED LICENSE FOR THE PLUMBING AND ELECTRICAL SUBCONTRACTORS. NO MUNICIPAL PERMIT OR INSPECTION IS REQUIRED. S 2. Section 101 of the general municipal law is amended by adding a new subdivision 6 to read as follows: 6. ALL PLUMBING AND ELECTRICAL WORK PERFORMED BY AN INDEPENDENT CONTRACTOR OR FIRM ON ANY SCHOOL BUILDING OR APPURTENANT FACILITIES SHALL BE PERFORMED BY A LICENSED PLUMBER OR LICENSED ELECTRICIAN AS APPROPRIATE, IF REQUIRED BY A LOCAL MUNICIPALITY WHERE THE BUILDING OR FACILITY IS LOCATED.
