BILL NUMBER:S5752 TITLE OF BILL: An act to amend the alcoholic beverage control law, in relation to notification of arrests and convictions PURPOSE OR GENERAL IDEA OF THE BILL: SUMMARY OF SPECIFIC PROVISIONS: Section 1. Subdivision 2 of section 106-a of the alcoholic beverage control law is renumbered subdivision 3 and a new subdivision 2 is added to read as follows: 2. The authority shall plan and coordinate with the arresting agency that is located in a city with a population of one million or more on a strategic plan to effectuate such transfer of information regarding the notification of arrests and convictions related to an activity or crime that has taken place on a licensed premise. The authority and the arresting agency shall seek input from the community regarding other relevant information that should be received by the authority from the arresting agency Such plan shall be posted on the agency's website by January first, two thousand fourteen and shall be annually updated thereafter. Section 2 This act shall take effect immediately.

KLEIN -- read twice and ordered printed, and when printed to be committed to the Committee on Investigations and Govern- ment Operations AN ACT to amend the alcoholic beverage control law, in relation to notification of arrests and convictions THE PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND ASSEM- BLY, DO ENACT AS FOLLOWS: Section 1. Subdivision 2 of section 106-a of the alcoholic beverage control law is renumbered subdivision 3 and a new subdivision 2 is added to read as follow: 2. THE AUTHORITY SHALL PLAN AND COORDINATE WITH THE ARRESTING AGENCY THAT IS LOCATED IN A CITY WITH A POPULATION OF ONE MILLION OR MORE ON A STRATEGIC PLAN TO EFFECTUATE SUCH TRANSFER OF INFORMATION REGARDING THE NOTIFICATION OF ARRESTS AND CONVICTIONS RELATED TO AN ACTIVITY OR CRIME THAT HAS TAKEN PLACE ON A LICENSED PREMISES. THE AUTHORITY AND THE ARRESTING AGENCY SHALL SEEK INPUT FROM THE COMMUNITY REGARDING OTHER RELEVANT INFORMATION THAT SHOULD BE RECEIVED BY THE AUTHORITY FROM THE ARRESTING AGENCY. SUCH PLAN SHALL BE POSTED ON THE AGENCY'S WEBSITE BY JANUARY FIRST, TWO THOUSAND FOURTEEN AND SHALL BE ANNUALLY UPDATED THER- EAFTER. S 2. This act shall take effect immediately.
