BILL NUMBER:S6426 TITLE OF BILL: An act to amend the legislative law, in relation to limitations on the effectiveness of provisions of law imposing or increasing certain fees PURPOSE: To require the Legislature to review and reevaluate any general revenue fee and ascertain if it is necessary to impose or increase that fee. SUMMARY OF PROVISIONS: Requires all legislation imposing or increasing any fee to expire within two years after the effective date. JUSTIFICATION: While fees have become a major source of revenue for the State, these "hidden taxes" have caused a burden to all taxpayers. A report issued in January, 1992, stated that 380 new fees and fee hikes were enacted since 1989, adding $343 million to the costs of living and working in New York State. To attain the economic recovery that is desperately needed in this State, it is imperative that every tax source be reviewed in an effort to lower New York State's tax burden.

BALL -- read twice and ordered printed, and when printed to be committed to the Committee on Investigations and Govern- ment Operations AN ACT to amend the legislative law, in relation to limitations on the effectiveness of provisions of law imposing or increasing certain fees THE PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND ASSEM- BLY, DO ENACT AS FOLLOWS: Section 1. The legislative law is amended by adding a new section 52-a to read as follows: S 52-A. LIMITATIONS ON PROVISIONS OF LAW AFFECTING FEES. EVERY PROVISION OF LAW RELATING TO THE IMPOSITION OR INCREASE OF ANY FEE TO BE DEPOSITED IN THE GENERAL FUND OF THE STATE SHALL EXPIRE AND BE OF NO FURTHER FORCE AND EFFECT NO LATER THAN TWO YEARS AFTER THE SAME SHALL HAVE TAKEN EFFECT. S 2. This act shall take effect on the first of January next succeed- ing the date on which it shall have become a law, and shall apply to legislative bills introduced on or after such effective date.
