BILL NUMBER:S6485 TITLE OF BILL: An act to amend the public service law, in relation to fuel cell electric generating equipment PURPOSE: To allow non-residential customer generators who are utilizing net metering for fuel cell electric generating equipment to install systems of up to 2,000 kilowatts. SUMMARY OF SPECIFIC PROVISIONS: Section 1-amends section 66-J of the public service law to increase the rated capacity of fuel cell electric generating equipment for non-residential customers from 1500 kilowatts to 2000 kilowatts. Section 2-Sets forth the effective date JUSTIFICATION: Fuel cell- electric generating equipment for non-residential customers was added to the technologies authorized to conduct net metering by chapter 530 of the laws of 2011. However, this chapter placed the upper limit in terms of rated capacity at 1500 kilowatts, which is wholly inconsistent with other technologies that are authorized for

MAZIARZ -- read twice and ordered printed, and when printed to be committed to the Committee on Energy and Telecommuni- cations AN ACT to amend the public service law, in relation to fuel cell elec- tric generating equipment THE PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND ASSEM- BLY, DO ENACT AS FOLLOWS: Section 1. Paragraph (g) of subdivision 1 of section 66-j of the public service law, as amended by chapter 530 of the laws of 2011, is amended to read as follows: (g) "Fuel cell electric generating equipment" means: (i)(A) in the case of a residential customer, a solid oxide, molten carbonate, proton exchange membrane or phosphoric acid fuel cell with a combined rated capacity of not more than ten kilowatts; and (B) in the case of a non-residential customer, a solid oxide, molten carbonate, proton exchange membrane or phosphoric acid fuel cell with a combined rated capacity of not more than [one] TWO thousand [five hundred] kilo- watts; and (ii) that is manufactured, installed and operated in accordance with applicable government and industry standards, that is connected to the electric system and operated in parallel with an electric corporation's transmission and distribution facilities, and that is operated in compliance with any standards and requirements established under this section.
