BILL NUMBER:S2088

TITLE OF BILL: An act to amend the public authorities law, in
relation to one-way or round trip tickets purchased for use on the
Long Island Rail Road and the Metro-North Commuter Railroad Company

PURPOSE OR GENERAL IDEA OF BILL: To eliminate the cost of mandated
surcharges for the cancellation of one-way or round trip Long Island
Rail Road and Metro-North Commuter Railroad Company tickets within six
months of their original purchase.

SUMMARY OF SPECIFIC PROVISIONS: Creates Section 1266-j of the public
authorities law; requiring the Metropolitan Transit Authority to
extend the validity of one-way or round trip Long Island Railroad and
Metro-North Railroad tickets to six months from the date of purchase
and to reimburse one hundred percent (100%) of the purchase price for
unused one-way or round Long Island Rail Road and Metro-North Commuter
Railroad Company tickets returned within six months of the date of
purchase and prohibiting the assessment of any surcharge or processing
fee for the returned ticket.

JUSTIFICATION: On December 30, 2010, the Metropolitan Transit
Authority (MIA) Board adopted a new refund policy for tickets
purchased for the Long Island Rail Road (LIRR) and Metro-North
Commuter Railroad Company. The recently instituted policy invalidates
Unused One Nay and Round Trip tickets within two weeks of the purchase
date. For a full refund, any unused tickets must be returned within 30
days of the purchase date. Prior to this policy's enactment, LIRR and
Metro-North tickets had been valid for up to six months.

This legislation will prolong the use of tickets for a reasonable
amount of time.

PRIOR LEGISLATIVE HISTORY: S. 3778D (2012) - Passed Senate S. 3778B
(2011) - Passed Senate

FISCAL IMPLICATIONS: Unknown.

EFFECTIVE DATE: This act shall take effect on the thirtieth day after
it shall have become a law.

BILL NUMBER:S2088A REVISED 5/27/14

TITLE OF BILL: An act to amend the public authorities law, in
relation to one-way or round trip tickets purchased for use on the
Long Island Rail Road and the Metro-North Commuter Railroad Company

PURPOSE: To ensure the validity of any one-way, round-trip or
multi-trip ticket, not purchased for a specific month or unlimited
travel, for one year from date of purchase and, additionally, to
ensure full reimbursement for returned tickets without additional
surcharges, intended for tickets purchased, for use on the Long Island
Rail Road or the Metro-North Commuter Railroad Company.

SUMMARY OF PROVISIONS:

Section one adds a new section 1266-j of the public authorities law;
requiring the Metropolitan Transit Authority to extend the validity of
one-way or round trip Long Island Railroad and Metro- North Railroad
tickets to one year from the date of purchase and to reimburse one
hundred percent (100%) of the purchase price for unused one-way or
round Long Island Rail Road and Metro-North Commuter Railroad Company
tickets returned within six months of the date of purchase and
prohibiting the assessment of any surcharge or processing fee for the
returned ticket. Additionally creates a new section 1266-k; providing
that additional train fare purchased after boarding by a passenger
with insufficient fare shall be rounded up to the nearest quarter.

Section two sets the effective date.

JUSTIFICATION: Frequent train passengers, who preplan and purchase an
extra ticket for future train rides, run the risk of their investments
being invalid after a short period of time. A one-way ticket is valid
for 90 days, however after 90 days the policy in place does not have
the option of reimbursement. This legislation provides an extension to
the expiration date of purchased tickets to one year and,
additionally, it requires full reimbursement of tickets at its
original value without additional fees. Currently there is a
processing fee of $10 per transaction.

This legislation would provide relief for riders who present an
off-peak ticket or other ticket which must, in MTA parlance, be
"stepped up". Formerly the customer was charged the difference in the
fare rounded up to the next dollar. This legislation will round it up
the next $.25.

LEGISLATIVE HISTORY: S.3778-B (2011 - 2012) - Passed Senate.

FISCAL IMPLICATIONS: Unknown.

EFFECTIVE DATE: This act shall take effect on the thirtieth day after
it shall have become a law.
