BILL NUMBER:S3554

TITLE OF BILL: An act to amend the vehicle and traffic law, in relation
to distinctive plates for gold star mothers

PURPOSE OR GENERAL IDEA OF BILL: This legislation will allow a Gold Star
Mother to keep one distinctive license plate, for commemorative purposes
only, upon surrender of such distinctive plates.

SUMMARY OF SPECIFIC PROVISIONS: Section one amends section 404-i of the
vehicle and traffic law by adding a new section which would allow a Gold
Star Mother to retain one of two distinctive license plates upon surren-
der of such set. The plate shall be retained for commemorative purposes
only.

Section two provides for an immediate effective date.

JUSTIFICATION: Currently, a Gold Star Mother is required to return her
distinctive license plates honoring her child killed in service when
surrendering her license. These license plates have great sentimental
value and are a source of pride for the mother of fallen military hero.

This bill would allow a Gold Star Mother to keep one of her plates as a
commemorative plate. It also allows the Commissioner of DMV to make a
duplicate plate of the surrendered Gold Star Mother license plate at no
cost to the Gold Star Mother in the event that she has surrendered both
plates.

AN ACT to amend the vehicle and traffic law, in relation to  distinctive
  plates for gold star mothers

  THE  PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND ASSEM-
BLY, DO ENACT AS FOLLOWS:

  Section 1. Section 404-i of the vehicle and traffic law is amended  by
adding a new subdivision 4 to read as follows:
  4.  UPON  THE SURRENDER OF A SET OF DISTINCTIVE PLATES ISSUED PURSUANT
TO THIS SECTION, THE GOLD STAR MOTHER TO WHOM SUCH PLATES  WERE  ISSUED,
SHALL  BE  ENTITLED  TO  KEEP AND RETAIN ONE OF THE TWO SUCH PLATES, FOR
COMMEMORATIVE PURPOSES ONLY AND NOT FOR DISPLAY ON ANY MOTOR VEHICLE. IN
THE EVENT THAT A GOLD  STAR  MOTHER  TO  WHOM  DISTINCTIVE  PLATES  WERE
ISSUED,  HAS  SURRENDERED  BOTH  PLATES  OF  THE SET OF SUCH DISTINCTIVE
PLATES, THEN THE COMMISSIONER SHALL, UPON REQUEST OF, AND AT NO COST  TO
SUCH  GOLD  STAR  MOTHER, ISSUE AND PROVIDE TO SUCH GOLD STAR MOTHER ONE
DUPLICATE COMMEMORATIVE PLATE OF THE DISTINCTIVE PLATES SO  SURRENDERED,
SO  THAT SUCH PERSON MAY KEEP AND RETAIN SUCH DUPLICATE PLATE FOR COMME-
MORATIVE PURPOSES ONLY AND NOT FOR DISPLAY ON ANY MOTOR VEHICLE.
  S 2. This act shall take effect immediately.
