BILL NUMBER:S3933

TITLE OF BILL: An act to amend the town law and the public officers
law, in relation to authorizing town justices in the town of
Piercefield, in the county of St. Lawrence, to reside outside such
town

PURPOSE: Provides that the town justice of the town of Piercefield,
in the county of St. Lawrence, need not be a resident of such town.

SUMMARY OF PROVISIONS:

Section 1 amends section 23 of the town law by adding a new
subdivision 26 to allow the town justice of the town of Piercefield to
not be an elector of such town.

Section 2 amends section 3 of the public officers law by adding a new
subdivision to allow the town justice of the town of Piercefield to
not be a resident of the town. Further the bill authorizes the person
to be a resident of an adjoining county within the state of New York.

Section 3 contains the effective date.

JUSTIFICATION: This legislation will allow the town of Piercefield to
select the most qualified person to be the town justice of the town of
Piercefield, regardless of his or her residency status. Without this
legislation the town of Piercefield would be limited to only being
able to choose a town justice from within the town itself. This
legislation has been requested by the town of Piercefield.

AN ACT to amend the town law and the public officers law, in relation to
  authorizing town justices in the town of Piercefield, in the county of
  St. Lawrence, to reside outside such town

  THE PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND  ASSEM-
BLY, DO ENACT AS FOLLOWS:

  Section  1.  Section  23  of  the  town law is amended by adding a new
subdivision 26 to read as follows:
  26. NOTWITHSTANDING THE PROVISIONS OF SUBDIVISION ONE OF THIS SECTION,
IN THE TOWN OF PIERCEFIELD, IN THE COUNTY OF ST. LAWRENCE,  THE  PERSONS
PERFORMING  THE  FUNCTIONS  OF TOWN JUSTICE NEED NOT BE ELECTORS OF SUCH
TOWN. PROVIDED, HOWEVER, THE PERSONS PERFORMING THE  FUNCTIONS  OF  TOWN
JUSTICE  IN  ANY OTHER TOWN SHALL BE ELECTORS OF SUCH TOWN UNLESS OTHER-
WISE PROVIDED BY LAW.
  S 2. Section 3 of the public officers law is amended by adding  a  new
subdivision 60 to read as follows:
  60.  IN  THE  TOWN  OF PIERCEFIELD, IN THE COUNTY OF ST. LAWRENCE, THE
PROVISIONS OF THIS SECTION REQUIRING A PERSON TO BE A  RESIDENT  OF  THE
POLITICAL SUBDIVISION OR MUNICIPAL CORPORATION OF THE STATE FOR WHICH HE
OR SHE SHALL BE CHOSEN OR WITHIN WHICH HIS OR HER OFFICIAL FUNCTIONS ARE
REQUIRED  TO  BE  EXERCISED, SHALL NOT PREVENT A PERSON FROM HOLDING THE
OFFICE OF TOWN JUSTICE OF THE TOWN OF PIERCEFIELD,  PROVIDED  THAT  SUCH
PERSON  RESIDES  IN ST. LAWRENCE OR AN ADJOINING COUNTY WITHIN THE STATE
OF NEW YORK. PROVIDED, HOWEVER, THE PERSON PERFORMING THE  FUNCTIONS  OF
TOWN  JUSTICE IN ANY OTHER TOWN SHALL BE A RESIDENT OF SUCH TOWN, UNLESS
OTHERWISE PROVIDED BY LAW.
  S 3. This act shall take effect immediately.
