BILL NUMBER:S4097

TITLE OF BILL: An act to amend the education law, in relation to
including chemistry, hematology, microbiology and blood banking
(immunohematology) as areas covered by a restricted clinical
laboratory license

PURPOSE: This bill would include chemistry, hematology, microbiology
and blood banking (immunohematology) as areas covered by a restricted
clinical laboratory license.

SUMMARY OF PROVISIONS:

Section 1 - Amends paragraph (a) of subdivision 2 of section 8610 of
the education law, as added by Chapter 204 of the laws of 2008.

Section 2 - Effective date

JUSTIFICATION: There is an annual demand of approximately 640 new
laboratory professionals while only approximately 230 are graduated
annually. In addition it has been estimated that 10% of the current
workforce plans to retire within the next five years.

NYSED law does not permit graduates from other states to obtain NYS
certification or licensure without passing the NYS general exam. This
bill would enable those individuals to do so by passing a specialty
exam.

In addition, this bill would extend current law set to expire later
this year allowing for the issuance of limited licenses to out of
state individuals to address the shortage of lab technicians with more
than 5 years experience needed for supervising positions. That section
would be extended until 2020.

AN ACT to amend the education law, in relation to  including  chemistry,
  hematology, microbiology and blood banking (immunohematology) as areas
  covered by a restricted clinical laboratory license

  THE  PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND ASSEM-
BLY, DO ENACT AS FOLLOWS:

  Section 1. Paragraph (a) of subdivision 1 and paragraph (a) of  subdi-
vision  2  of section 8610 of the education law, as added by chapter 204
of the laws of 2008, are amended to read as follows:
  (a) The department may issue a restricted license  pursuant  to  which
the  restricted  licensee  may  receive a certificate to perform certain
examinations and procedures within the definition of clinical laboratory
technology set forth in subdivision one of  section  eighty-six  hundred
one  of  this  article,  provided  that  such  a restricted licensee may
perform examinations and procedures only in those of the following areas
which are specifically listed in his or her certificate:   histocompati-
bility,  cytogenetics,  stem cell process, flow cytometry/cellular immu-
nology, CHEMISTRY, HEMATOLOGY, MICROBIOLOGY AND BLOOD BANKING (IMMUNOHE-
MATOLOGY) and molecular diagnosis to the extent such molecular diagnosis
is included in genetic testing-molecular and molecular oncology.
  (a) The department may issue a limited license and registration pursu-
ant to which the limited licensee may perform  examinations  and  proce-
dures  within the definition of clinical laboratory technology set forth
in subdivision one of section eight thousand six  hundred  one  of  this
article,  provided  that  an individual qualifying for a limited license
pursuant to clause three of subparagraph (ii) of paragraph (b)  of  this
subdivision  shall  perform  only those examinations and procedures that
are for the purpose of human trials of such examinations and  procedures
as  were  the  subject  of  the  individual's  research and that nothing
contained in this subdivision shall authorize any individual to  provide

any  examinations  or  procedures  that  he  or  she  is prohibited from
performing pursuant to the public health law, and provided further  that
an  individual  qualifying for a limited license pursuant to clause four
of  subparagraph (ii) of paragraph (b) of this subdivision shall perform
only those examinations and procedures that  are  within  the  scope  of
practice  of  histological technicians. A limited license may be granted
to an applicant who is employed  in  a  clinical  laboratory  under  the
direction  of  a  clinical director and may be issued for the purpose of
enabling the applicant to complete the education and to  pass  the  exam
required  for  licensure as a clinical laboratory technologist or histo-
logical technician in New York state, as applicable. Notwithstanding the
provisions of section sixty-five hundred two of this title,  no  limited
license  shall  be valid beyond September first, two thousand [thirteen]
TWENTY, and the registration issued with the limited  license  shall  be
effective until September first, two thousand [thirteen] TWENTY.
  S 2. This act shall take effect immediately.
