TITLE OF BILL: An act to amend chapter 321 of the laws of 2011,
amending the environmental conservation law relating to allowing the
use of rifles for deer hunting in the county of Chautauqua, in
relation to making the provisions thereof permanent

PURPOSE: This bill makes permanent the provisions of the
environmental conservation law allowing the use of rifles for deer and
bear hunting in a portion of the county of Chautauqua.

SUMMARY OF PROVISIONS:

Section one of the bill repeals the sunset date of the current
authorization for rifle hunting in parts of the county of Chautauqua,
thereby making the authorization permanent.

Section two provides for an immediate effective date upon enactment.

JUSTIFICATION: In several areas of the State, sportsmen are allowed
to hunt bear and deer with rifles and this change in law would allow
the use of rifles in portions of Chautauqua County.

LEGISLATIVE HISTORY: This is a new bill.

FISCAL IMPLICATIONS: None to the state.

EFFECTIVE DATE: This act shall take effect immediately.

AN ACT to amend chapter 321 of the laws of 2011, amending  the  environ-
  mental  conservation  law  relating  to allowing the use of rifles for
  deer hunting in the county of Chautauqua, in relation  to  making  the
  provisions thereof permanent

  THE  PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND ASSEM-
BLY, DO ENACT AS FOLLOWS:

  Section 1. Section 3 of chapter 321 of the laws of 2011, amending  the
environmental  conservation  law  relating to allowing the use of rifles
for deer hunting in the county of Chautauqua,  is  amended  to  read  as
follows:
  S 3.  This act shall take effect immediately, provided that:
  a.  the  amendments  to  item  (i)  of paragraph a of subdivision 2 of
section 11-0907 of the environmental conservation law  made  by  section
one of this act shall be subject to the expiration and reversion of such
paragraph  pursuant to section 13 of chapter 600 of the laws of 1993, as
amended, when upon such date the provisions of section two of  this  act
shall take effect; AND
  b.  the  amendments  to  item  (i)  of paragraph a of subdivision 2 of
section 11-0907 of the environmental conservation law  made  by  section
two of this act shall be subject to the expiration and reversion of such
paragraph  pursuant to section 17 of chapter 483 of the laws of 2010, as
amended[;
  c. nothing contained in this act shall be construed so  as  to  extend
the  provisions  of this act beyond January 1, 2014, when upon such date
this act shall expire and  the  provisions  contained  herein  shall  be
deemed repealed].
  S 2. This act shall take effect immediately.

AN  ACT  to amend chapter 321 of the laws of 2011, amending the environ-

  provisions thereof permanent; and to amend the environmental conserva-
  tion law, in relation to making deer hunting in the county of Chautau-
  qua permanent

  THE PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND  ASSEM-
BLY, DO ENACT AS FOLLOWS:

  Section  1. Section 3 of chapter 321 of the laws of 2011, amending the
environmental conservation law relating to allowing the  use  of  rifles
for  deer  hunting  in  the  county of Chautauqua, is amended to read as
follows:
  S 3.  This act shall take effect immediately, provided that[:
  a.] the amendments to item (i) of paragraph  a  of  subdivision  2  of
section  11-0907  of  the environmental conservation law made by section
one of this act shall be subject to the expiration and reversion of such

  S  2. Item (i) of paragraph (a) of subdivision 2 of section 11-0907 of
the environmental conservation law, as amended by  chapter  600  of  the
laws of 2005, is amended to read as follows:

(i) The counties of       Deer and bear, the      Pistol, shotgun,
  Allegany, Cattaraugus,  first Monday after      muzzle loading
  CHAUTAUQUA EXCEPT       November 15 through     firearm, rifle
  THAT PORTION OF THE     first Tuesday after     or long bow
  COUNTY NORTH OF         December 7              only
  ROUTE 20,
  Chenango, Herkimer,
  Montgomery, Oneida,
  Oswego, Otsego,
  Schoharie and Tioga
  and that portion
  of the county
  of Broome east of the
  Susquehanna river

  S  3.  This act shall take effect immediately; except that section two
of this act shall take effect on the expiration of section 1 of  chapter
321 of the laws of 2011.
