BILL NUMBER:S4810

TITLE OF BILL: An act to amend the real property tax law, in relation
to authorizing the commissioner of taxation and finance to develop in
consultation with the director of the New York state division of
veterans' affairs a listing of documents to be used to establish
veterans' eligibility for certain property tax exemptions

PURPOSE OR GENERAL IDEA OF BILL: This measure would authorize the
commissioner of taxation and finance to develop a listing of documents
to be used to establish veterans' eligibility for the three veterans
real property tax exemptions (eligible funds exemption; alternative
veterans exemption and the cold war veterans exemption.)

SUMMARY OF SPECIFIC PROVISIONS:

Section 1: adds a new subdivision 10 to the eligible funds exemption
that would require the commissioner of taxation and finance to consult
with the director of the division of veterans' affairs to develop a
list of acceptable documents to be used to establish eligibility for
this veterans' exemption.

Section 2: adds a new subdivision 9 to the alternative veterans
exemption that would require the commissioner of taxation and finance
to consult with the director of the division of veterans' affairs to
develop a list of acceptable documents to be used to establish
eligibility for this veterans' exemption.

Section 3: adds a new subdivision 8 to the cold war veterans exemption
that would require the commissioner of taxation and finance to consult
with the director of the division of veterans' affairs to develop a
list of acceptable documents to be used to establish eligibility for
this veterans' exemption.

Section 4: Sets the effective date.

JUSTIFICATION: Currently, the Office of Real Property Tax Services
(ORPTS), which is under the jurisdiction of the commissioner of
taxation and finance, works with the New York State Division of
Veterans' Affairs to supply a list of acceptable documents that can be
used to establish eligibility for the three veterans' real property
tax exemptions. This information is supplied to assessors and is
available in the assessor's manual that is updated each year by the
ORPTS with the help of the division. This measure places current
practice into law and ensures that this information is available to
the numerous veterans advocates that help those who have served in our
military file the these exemptions properly.

PRIOR LEGISLATIVE HISTORY: A.10052 (2012)

FISCAL IMPLICATIONS: None to state.

EFFECTIVE DATE: This act shall take effect on the one hundred
twentieth day after it shall have became a law; provided that,
effective immediately, the commissioner of the department of taxation
and finance and the director of the division of veterans' affairs are
authorized and directed to promulgate and implement any rules and


regulations necessary for the implement of the provisions of this act
on or before its effective date.

AN ACT to amend the real property tax law, in  relation  to  authorizing
  the  commissioner  of  taxation and finance to develop in consultation
  with the director of the New York state division of veterans'  affairs
  a  listing  of documents to be used to establish veterans' eligibility
  for certain property tax exemptions

  THE PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND  ASSEM-
BLY, DO ENACT AS FOLLOWS:

  Section  1.  Section  458  of  the real property tax law is amended by
adding a new subdivision 10 to read as follows:
  10. THE COMMISSIONER SHALL DEVELOP IN CONSULTATION WITH  THE  DIRECTOR
OF  THE  NEW YORK STATE DIVISION OF VETERANS' AFFAIRS A LISTING OF DOCU-
MENTS TO BE USED TO ESTABLISH ELIGIBILITY UNDER THIS SECTION,  INCLUDING
BUT  NOT  LIMITED  TO  A CERTIFICATE OF RELEASE OR DISCHARGE FROM ACTIVE
DUTY  ALSO  KNOWN  AS  A   DD-214   FORM   OR   AN   HONORABLE   SERVICE
CERTIFICATE/REPORT  OF  CAUSALITY  FROM THE DEPARTMENT OF DEFENSE.  SUCH
INFORMATION SHALL BE MADE  AVAILABLE  TO  EACH  COUNTY,  CITY,  TOWN  OR
VILLAGE  ASSESSOR'S  OFFICE, OR CONGRESSIONAL CHARTERED VETERANS SERVICE
OFFICERS WHO REQUEST SUCH INFORMATION. THE LISTING OF  ACCEPTABLE  MILI-
TARY  RECORDS  SHALL  BE  MADE AVAILABLE ON THE INTERNET WEBSITES OF THE
DIVISION OF VETERANS' AFFAIRS  AND  THE  OFFICE  OF  REAL  PROPERTY  TAX
SERVICES.
  S 2. Section 458-a of the real property tax law is amended by adding a
