BILL NUMBER:S5366

TITLE OF BILL:

An act to amend the highway law, in relation to designating a portion
of state route five-a and five-s in Oneida county as the "Officer
Thomas M. Lindsey memorial highway"

PURPOSE:

To memorialize a portion of State Route 5a and 5s in Oneida county as
the "Officer Thomas M. Lindsey Memorial Highway".

SUMMARY OF PROVISIONS:

* Section one of the bill adds a new section 343-aa to the highway
law, which states that a portion of the state highway system will be
designated as the "Officer Thomas M. Lindsey Memorial Highway".

* Section two states that the commissioner of transportation shall
provide further installation and maintenance of adequate signing of
the state highway system as designated by section one of this act.

* Section three provides for an immediate effective date.

JUSTIFICATION:

The purpose of this bill is to designate a portion of State Route 5a
and 5s in Oneida county as the "Officer Thomas M. Lindsey Memorial
Highway".

Officer Lindsey was a five year veteran of the Utica Police
Department. He made the ultimate sacrifice protecting the citizens of
the city of Utica when on April 12, 2007, he was gunned down during a
traffic stop.

Officer Lindsey's bravery and devotion to the UPD is demonstrated by
the several Certificates of Commendation he has been awarded for his
honorable service in the East Utica and Cornhill areas. He has been
credited for his alertness, teamwork, dedication, keen powers of
observation, and the uncanny ability to quickly diffuse a dangerous
situation. He was also a proud member of the United States Marine
Corps, where he served his duty overseas protecting our country as an
Embassy Security Guard from 1993-1999.

Officer Lindsey gave everything he had to the UPD and the citizens of
Oneida County during his five year career. For the acts of bravery he
displayed not only on that tragic day, but each and every day, this
memorial highway should serve as a constant reminder of this devoted
officer's supreme sacrifice.

AN ACT to amend the highway law, in relation to designating a portion of
  state route five-a and five-s in Oneida county as the "Officer  Thomas
  M.  Lindsey memorial highway"

  THE  PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND ASSEM-
BLY, DO ENACT AS FOLLOWS:

  Section 1. The highway law is amended by adding a new  section  343-aa
to read as follows:
  S  343-AA.  PORTION  OF  STATE  HIGHWAY SYSTEM TO BE DESIGNATED AS THE
"OFFICER THOMAS M. LINDSEY MEMORIAL  HIGHWAY".  THAT  PORTION  OF  STATE
ROUTE FIVE-A FROM ITS INTERSECTION WITH WHITESBORO STREET AT THE WESTER-
LY  UTICA  CITY  LINE IN ONEIDA COUNTY, THENCE RUNNING EASTERLY TO WHERE
STATE ROUTE FIVE-A BECOMES STATE ROUTE FIVE-S ON ORISKANY STREET, THENCE
RUNNING GENERALLY EASTERLY ALONG STATE ROUTE FIVE-S TO ITS  INTERSECTION
WITH  BROAD STREET, SHALL BE DESIGNATED AND KNOWN AS THE "OFFICER THOMAS
M. LINDSEY MEMORIAL HIGHWAY."
  S 2. The commissioner of transportation shall provide for the  instal-
lation  and  maintenance of adequate signing of the state highway system
as designated pursuant to section one of this  act.  However,  to  avoid
confusion  and  to limit any possible disruption of commerce, the desig-
nation called for pursuant to section one of this act shall  be  one  of
ceremonial  nature  and  the  official name of such highway shall not be
changed as a result of this act.
  S 3. This act shall take effect immediately.
