BILL NUMBER:S5781

TITLE OF BILL: An act to direct the commissioner of education to pay
the Uniondale union free school district its full state aid
apportionment notwithstanding the failure of the California Avenue
school to be in session 180 days during the 2012--2013 school year

PURPOSE:

Ensures Uniondale Union Free School District does not receive a
reduction despite the failure of the elementary school to be in
session 180 days.

SUMMARY OF PROVISIONS:

Section one provides that the Commissioner of Education is authorized
to disregard the reduction of state aid required by Education Law
3604 due to the elementary school being in attendance for only 179
days.

Section two provides that this act shall take effect immediately.

JUSTIFICATION:

Education Law ยง 3604 provides that, in apportionment of state funds,
no school district shall be entitled to any portion of such school
moneys on such apportionment unless the school was in session for 180
days. On May 17th, the Uniondale elementary school located on
California Avenue was forced to close due to the home invasion that
occurred across the street from the school, which tragically led to
the death of a Hofstra student and the intruder. These events occurred
in the early morning hours and the California Avenue school became
part of a crime scene used by the police during the course of the
criminal investigation for the entire day. As a result of Super Storm
Sandy, the District had exhausted all of its snow days and was unable
to complete the state requirement for the academic calendar year. This
legislation will ensure the District is not penalized for failing to
meet the 180 day requirement as such failure was due to no fault of
the school district.

LEGISLATIVE HISTORY:

New bill.

FISCAL IMPLICATIONS:

None.

EFFECTIVE DATE:

Immediately.
