BILL NUMBER:S6679

TITLE OF BILL: An act to amend the executive law, in relation to
providing for an increase in the rates of compensation for gold star
parents

PURPOSE: To provide for an annual increase in the rate of compensation
for Gold Star Parents.

SUMMARY OF PROVISIONS: Amends paragraph (a) of subdivision 1 of
section 367 of the executive law to allow for an increase of the
annual annuity payment of Gold Star Parents by the same percentage as
benefit amounts payable under title II of the Social Security Act (42
USC 401 et seq.) effective December first, two thousand thirteen.

EXISTING LAW: A Gold Star Parent shall be paid an annual annuity for
the sum of five hundred dollars. There is no provision for a cost of
living increase.

JUSTIFICATION: The Gold Star annuity is a special income-eligible
annuity for parents that have lost a son or daughter in the armed
services during a time of war. It is recognition of the emotional loss
and of the financial implications to parents of the deceased, as there
are many instances in which the deceased contributed to the financial
well-being of his or her parents. Since its implementation in 2008,
the Gold Star Parent Annuity has not been increased. As inflation and
other economic factors cause prices to rise, the support we give to
the parents of those who died serving this country should not fall
behind. Thus, this Legislature has an obligation to allow the Gold
Star Parent Annuity to increase by the same annual cost of living
adjustment that the federal government provides in veterans' benefits.

LEGISLATIVE HISTORY: This is a new bill.

FISCAL IMPLICATIONS: The fiscal implications will be minimal to the
State of New York.

EFFECTIVE DATE: Immediately.

AN  ACT  to  amend  the  executive  law, in relation to providing for an
  increase in the rates of compensation for gold star parents

  THE PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND  ASSEM-
BLY, DO ENACT AS FOLLOWS:

  Section 1. Paragraph (a) of subdivision 1 of section 367 of the execu-
tive  law,  as  added  by chapter 399 of the laws of 2007, is amended to
read as follows:
  (a) A parent, identified in 10 USC 1126 as a gold star  parent,  of  a
veteran  who heretofore has died or parent of a veteran dying hereafter,
shall upon application to the state director, be paid an annual  annuity
out of the treasury of the state for the sum of five hundred dollars for
such  term as such parent shall be entitled thereto under the provisions
of this article. [In no event shall such annual annuity  payment  exceed
one  thousand  dollars  per  veteran]  THE AMOUNT OF ANY ANNUITY PAYABLE
UNDER THIS SECTION SHALL BE THE SAME AMOUNT AS THE  ANNUITY  PAYABLE  IN
THE  PRECEDING  YEAR, INCREASED BY THE SAME PERCENTAGE AS THE PERCENTAGE
BY WHICH BENEFIT AMOUNTS PAYABLE UNDER TITLE II OF THE  SOCIAL  SECURITY
ACT  (42  USC  401  ET SEQ.) ARE INCREASED EFFECTIVE DECEMBER FIRST, TWO
THOUSAND THIRTEEN.  The term "parent" for the purposes of  this  section
includes mother, father, stepmother, stepfather, mother through adoption
and father through adoption.
  S 2. This act shall take effect immediately.
