BILL NUMBER:S7318 TITLE OF BILL: An act to amend the public authorities law, in relation to authorizing the New York state olympic regional development authority to operate and manage ski and recreational facilities on lands in the vicinity of the Belleayre Mountain ski center, in Ulster and Delaware counties PURPOSE: The legislation, if enacted, would authorize the Olympic Regional Development Authority (ORDA) to operate and manage ski and recreational facilities located on properties in the vicinity of the Belleayre Mountain ski center. SUMMARY OF PROVISIONS: Section 2614 of the Public Authorities Law is amended to allow for this contractual authority. EXISTING LAW: No current legislative authority exists for this public-private partnership, however, it is important to note that in 2000, Chapter 192 was enacted to allow ORDA to operate such facilities on the lands of the Town of Johnsburgh.

SEWARD -- read twice and ordered printed, and when printed to be committed to the Committee on Corporations, Authorities and Commissions AN ACT to amend the public authorities law, in relation to authorizing the New York state olympic regional development authority to operate and manage ski and recreational facilities on lands in the vicinity of the Belleayre Mountain ski center, in Ulster and Delaware counties THE PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND ASSEM- BLY, DO ENACT AS FOLLOWS: Section 1. Section 2614 of the public authorities law is amended by adding a new subdivision 6 to read as follows: 6. THE AUTHORITY IS HEREBY AUTHORIZED TO ENTER INTO AGREEMENTS WITH LAND OWNERS OF PROPERTIES IN THE VICINITY OF THE BELLEAYRE MOUNTAIN SKI CENTER LOCATED IN ULSTER AND DELAWARE COUNTIES, STATE OF NEW YORK, TO OPERATE, MAINTAIN AND MANAGE THE SKI AND RECREATIONAL FACILITIES ON LANDS IN THE VICINITY OF THE BELLEAYRE MOUNTAIN SKI CENTER FOR THE BENE- FIT OF THE PUBLIC. THE SPECIFIED TERMS OF SUCH AGREEMENT SHALL BE NEGO- TIATED BY THE AUTHORITY. ALL OF THE POWERS OF THE AUTHORITY PROVIDED BY THIS TITLE OR ANY OTHER LAW, INCLUDING THOSE PERTAINING TO PARTICIPATING OLYMPIC FACILITIES, SHALL APPLY IN CONNECTION WITH SUCH AGREEMENT AND THE OPERATION AND MANAGEMENT OF SUCH FACILITIES.
