BILL NUMBER:S7596 TITLE OF BILL: An act authorizing the county of Nassau to alienate certain parcels of land used as parkland PURPOSE: This bill provides Nassau County with the authority to discontinue permanently a parcel of parkland and to convey the parcel to the Roslyn Water District. SUMMARY OF PROVISIONS: Section 1 authorizes the county of Nassau, acting through its legislature, to discontinue permanently a parcel of parkland and to convey such parcel to the Roslyn Water District. Section 2 provides that this alienation of parkland shall only be effective upon the condition that the county of Nassau dedicate an amount equal to or greater than the fair market value of the parkland being permanently discontinued for funding of capital improvements to existing park and recreational facilities. Section 3 provides the metes and bounds description for the parcel of parkland that is being permanently discontinued and alienated.

MARTINS -- read twice and ordered printed, and when printed to be committed to the Committee on Local Government AN ACT authorizing the county of Nassau to alienate certain parcels of land used as parkland THE PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND ASSEM- BLY, DO ENACT AS FOLLOWS: Section 1. The county of Nassau is hereby authorized, acting by and through its legislature, and upon such terms and conditions as deter- mined by such legislature, to discontinue permanently as parkland the lands described in section three of this act and to convey such parcel to the Roslyn Water District. S 2. The authorization contained in section one of this act shall be effective only upon the condition that the county of Nassau dedicate an amount equal to or greater than the fair market value of the parkland being permanently discontinued for funding of capital improvements, to existing park and recreational facilities. S 3. The lands to be discontinued as parklands and alienated and conveyed are described as follows: All that certain piece or parcel of land situated at North Hills, Town of North Hempstead, County of Nassau and State of New York, being known as a portion of Lot 903 "Christopher Morley Park", Block E as it appears on a certain map entitled "Department of Public Works Nassau County NY Map Showing Real Property To Be Acquired For Park Purposes East of Sear- ingtown Road And North Of Long Island Expressway North Hills Town Of North Hempstead" filed with the Clerk of the County of Nassau on Septem- ber 29, 1961 as Case No. 7496, said parcel being more particularly described as follows: Beginning at a point on the southerly side of Diana's Trail. Said point being the following two courses from the intersection of the southerly side of Diana's Trail with the westerly side of The Tulips: 1. South 89 degrees, 18 minutes, 51 seconds west, 237.50 feet. 2. South 87 degrees, 37 minutes, 30 seconds west, 437.00 feet to a point or place of beginning.
