BILL NUMBER:S4455
TITLE OF BILL:
An act to amend the general business law, in relation to billboards
advertising alcoholic beverages and provocative content to minors on
state owned property
PURPOSE:
To protect children from negative messages and protect the families
from intrusion of content inappropriate for children while using mass
transit, public transportation or at a public space or facility.
SUMMARY OF PROVISIONS:
Section 1 amends general business law by adding a new section 397-b
regulating content of bill boards on state owned property so as not to
contain alcoholic beverages or content inappropriate for minors. Part
2 defines a bill board and content inappropriate for minors.
JUSTIFICATION:
Our buses, subways, trains, and public spaces and building are covered
with billboards pushing alcohol and inappropriate content at our
children. Many of these are state owned property. We must take

AN ACT to amend the general business law, in relation to billboards
advertising alcoholic beverages and provocative content to minors on
state owned property
THE PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND ASSEM-
BLY, DO ENACT AS FOLLOWS:
Section 1. The general business law is amended by adding a new section
397-b to read as follows:
S 397-B. BILLBOARDS ADVERTISING ALCOHOLIC BEVERAGES OR INAPPROPRIATE
CONTENT TO MINORS ON STATE OWNED PROPERTY. 1. NO BILLBOARD ADVERTISING
ANY ALCOHOLIC BEVERAGE OR CONTAINING CONTENT INAPPROPRIATE FOR MINORS
SHALL BE ERECTED OR MAINTAINED ON THE PROPERTY OF OR UNDER THE AUTHORITY
OF THE STATE.
2. FOR PURPOSES OF THIS SECTION:
A. "BILLBOARD" SHALL INCLUDE ANY BILLBOARD, SIGN, NOTICE, POSTER,
DISPLAY OR OTHER STATIONARY DEVICE INTENDED TO ATTRACT OR WHICH DOES
ATTRACT THE ATTENTION OF OPERATORS OF MOTOR VEHICLES OR PEDESTRIANS.
B. "CONTENT INAPPROPRIATE FOR MINORS" SHALL INCLUDE CONTENT DESCRIP-
TIVE OF, ADVOCATING OR GLAMORIZING THE COMMISSION OF A VIOLENT CRIME,
ANY FORM OF SEXUALLY PROVOCATIVE OR SUGGESTIVE BEHAVIOR, NUDITY, PARTIAL
NUDITY OR THAT DEPICTS AND SHOWS ONLY MALE OR FEMALE UNDERGARMENTS.
S 2. This act shall take effect on the ninetieth day after it shall
have become a law.

To protect children from advertising that is inappropriate while using
mass transit, public transportation or at a public space or facility.

regulate billboards on state owned property. Part 2 defines a
billboard and content inappropriate for minors.
JUSTIFICATION:
Our buses, subways, trains, and public spaces and building are covered
with billboards pushing inappropriate behavior at our children. Many
of these are state owned property. We must take responsibility for the
way we as a state raise revenue and not do raise revenue of portrayals
of offensive or inappropriate content.
We regulate the advertising of cigarettes on billboards however we do
not do the same for content that is not appropriate for minors. It is
