BILL NUMBER:S4639 TITLE OF BILL: An act to amend the insurance law, in relation to permitting pregnant women to enroll in the state health insurance exchange at any time PURPOSE OR GENERAL IDEA OF BILL: To add pregnancy to the series of qualifying events that trigger a special enrollment period for the state health insurance exchange so that pregnant individuals can enroll in a health plan through the exchange at any time. SUMMARY OF SPECIFIC PROVISIONS: Section one adds a new section 3114 to the insurance law to provide that pregnancy shall be an event that triggers a special enrollment period available to individuals for enrollment at any time in a qualified health plan in the state health insurance exchange. This section also provides that the date of health plan coverage is effective on the date of the application. Section two provides the effective date. JUSTIFICATION:

KRUEGER -- read twice and ordered printed, and when printed to be committed to the Committee on Insurance AN ACT to amend the insurance law, in relation to permitting pregnant women to enroll in the state health insurance exchange at any time THE PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND ASSEM- BLY, DO ENACT AS FOLLOWS: Section 1. The insurance law is amended by adding a new section 3114 to read as follows: S 3114. ENROLLMENT IN THE STATE HEALTH INSURANCE EXCHANGE; PREGNANCY. IN ADDITION TO ANY TRIGGERING EVENT THAT PROVIDES ELIGIBILITY FOR A SPECIAL ENROLLMENT PERIOD AVAILABLE TO INDIVIDUALS FOR ENROLLMENT IN A QUALIFIED HEALTH PLAN IN THE STATE HEALTH INSURANCE EXCHANGE ESTABLISHED PURSUANT TO THE FEDERAL PATIENT PROTECTION AND AFFORDABLE CARE ACT (P.L. 111-148), THE STATE HEALTH INSURANCE EXCHANGE SHALL ALLOW FOR THE ENROLLMENT OF A PREGNANT INDIVIDUAL AT ANY TIME AFTER THE COMMENCEMENT OF THE PREGNANCY, TWO WEEKS AFTER THE INDIVIDUAL'S LAST MENSTRUAL PERI- OD. UPON SUCH ENROLLMENT, ANY QUALIFIED HEALTH PLAN IN THE STATE HEALTH INSURANCE EXCHANGE SHALL ENSURE THAT COVERAGE IS EFFECTIVE ON THE DATE OF APPLICATION. S 2. This act shall take effect immediately.
