BILL NUMBER:S4741 TITLE OF BILL: An act to amend the education law, in relation to private school agent's certificates PURPOSE: To add the online education marketplace as a facilitator between students and schools. SUMMARY OF PROVISIONS: Section 1 of this bill amends Education Law section 5004(1)(a) to provide that a party serving as an online education marketplace to the list of parties that may solicit or enroll any student for instruction within and without the state of New York. This amendment also defines "online education marketplace" as a neutral forum in which or through such forum a student can enroll in classes from a school or through which exchange of information is arranged between the student and school and the online education marketplace. Section 2 of this bill provides that this act shall take effect immediately.

GOLDEN -- read twice and ordered printed, and when printed to be committed to the Committee on Higher Education AN ACT to amend the education law, in relation to private school agent's certificates THE PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND ASSEM- BLY, DO ENACT AS FOLLOWS: Section 1. Paragraph a of subdivision 1 of section 5004 of the educa- tion law, as added by chapter 887 of the laws of 1990, is amended to read as follows: a. No party may, for a consideration or remuneration procure, solicit or enroll any student for instruction in or given by any school within or without the state of New York, unless (i) the party is a salaried employee of the school [and], (ii) the party shall have secured a private school agent's certificate from the department pursuant to regu- lations of the commissioner, AND (III) THE PARTY SERVES AS AN ONLINE EDUCATION MARKETPLACE FACILITATING INFORMATION BETWEEN STUDENTS AND SCHOOLS. UNDER THIS SECTION "ONLINE EDUCATION MARKETPLACE" MEANS A NEUTRAL FORUM IN WHICH, OR BY MEANS OF WHICH, A STUDENT MAY ENROLL IN CLASSES FROM A SCHOOL, OR ARRANGES FOR THE EXCHANGE OF INFORMATION OR MESSAGES BETWEEN THE STUDENT AND SCHOOL AND THE ONLINE EDUCATION MARKET- PLACE. Adds the definition of an "online education marketplace" within § 5001 of the education law, relating to licensed private career schools. Section 2. Amends § 5004 of the education law, relating to a private school agent's certificate, to create a new exemption for an online education marketplace to offer advertising, marketing, or services in connection with the collection of tuition and fees from requirements relating to obtaining a private school agent's certificate. The section also sets standards for an "online education marketplace" to comply with before qualifying for the exemption. JUSTIFICATION : This legislation would promote access to learning through the online education place model, which increases educational opportunity for the citizens of New York State while supporting emerging technologies and

Paragraphs a and b of subdivision 1 of section 5001 of the education law, as amended by chapter 381 of the laws of 2012, are amended and a new paragraph c is added to read as follows: a. "licensed private career school" or "licensed private school" shall mean any entity offering to instruct or teach any subject by any plan or method including written, visual or audio-visual methods, and shall include any institution licensed or registered as a registered business school or computer training facility on the effective date of the chap- ter of the laws of two thousand twelve which amended this subdivision. Following such effective date, there shall be no distinction between institutions previously defined as "registered business schools" or "computer training facilities" and other licensed private schools, and any reference in law to a registered business school or computer train- ing facility shall be deemed a reference to a licensed private career school. Institutions holding a valid business school registration on such effective date, including computer-training facilities, shall have such registrations replaced by the commissioner, at no cost, with licenses valid until the expiration date listed on such previous regis- tration; [and] b.
