BILL NUMBER:S5025 TITLE OF BILL: An act to amend the workers' compensation law, in relation to livery driver benefit fund SUMMARY OF PROVISIONS: This bill amends section 18-C of the workers compensation law to provide authorized no-fault insurers with the necessary powers to implement the provisions of the workers compensation law. JUSTIFICATION: Chapter 392 of the Laws of 2008, for the first time, required commercial no-fault auto insurers to provide workers compensation benefits to certain injured livery drivers The 2008 law, however, failed to include the necessary authorization to allow those insurers to accomplish the purposes of workers compensation coverage. This amendment corrects this problem by granting the necessary authorization to insure that injured drivers receive prompt and appropriate treatment designed to enhance their ability to return to work. The public would also be protected under this bill by including existing provisions governing driving restrictions while receiving

GOLDEN -- read twice and ordered printed, and when printed to be committed to the Committee on Labor AN ACT to amend the workers' compensation law, in relation to livery driver benefit fund THE PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND ASSEM- BLY, DO ENACT AS FOLLOWS: Section 1. Section 18-c of the workers' compensation law is amended by adding a new subdivision 9 to read as follows: 9. AN INDEPENDENT LIVERY DRIVER WHO SUBMITS A CLAIM FOR RECOVERY IN ACCORDANCE WITH ARTICLE FIFTY-ONE OF THE INSURANCE LAW PURSUANT TO SUBDIVISION EIGHT OF THIS SECTION SHALL BE SUBJECT TO LOCAL TAXI AND LIMOUSINE COMMISSION RULES PROHIBITING DRIVING UNTIL HE OR SHE HAS RECOVERED FROM HIS OR HER INJURY. ANY AUTHORIZED INSURER REQUIRED TO ACCEPT SUCH CLAIMS SHALL BE ENTITLED TO APPLY THE PRE-AUTHORIZED PROCE- DURES, MEDICAL TREATMENT GUIDELINES AND OTHER APPLICABLE PROVISIONS OF THIS ARTICLE. S 2.
