BILL NUMBER:S5063 TITLE OF BILL: An act to grant Joseph Perri eligibility for permanent appointment as a full-time police officer with the police department of the city of Little Falls, in the county of Herkimer PURPOSE: To make Joseph Perri, a part-time police officer of the city of Little Falls Police Department, at the request of the chief of police and mayor of Little Falls, eligible for permanent appointment as a full-time police officer. SUMMARY OF PROVISIONS: Section 1 provides eligibility for permanent appointment in the competitive class of civil service, provided that Officer Perri be forty-five years of age or younger. SEWARD -- read twice and ordered printed, and when printed to be committed to the Committee on Civil Service and Pensions AN ACT to grant Joseph Perri eligibility for permanent appointment as a full-time police officer with the police department of the city of Little Falls, in the county of Herkimer THE PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND ASSEM- BLY, DO ENACT AS FOLLOWS: Section 1. Notwithstanding any provision of paragraph (a) of subdivi- sion 1 of section 58 of the civil service law, Joseph Perri, who has been continuously employed as a part-time police officer by the police department of the city of Little Falls, in the county of Herkimer, since November 1, 2010, and who is over the age of 35, shall be eligible for permanent appointment in the competitive class of civil service as a full-time police officer of the police department of the city of Little Falls, if he shall, at the time of appointment, be 45 years of age or younger. S 2. This act shall take effect immediately. EXPLANATION--Matter in ITALICS (underscored) is new; matter in brackets [ ] is old law to be omitted. LBD10651-02-5

BILL NUMBER:S5063A TITLE OF BILL: An act to authorize Joseph Perri to take the competitive civil service examination and be placed on the eligible list for appointment as a full-time police officer for the city of Little Falls, county of Herkimer PURPOSE: To allow Officer Perri, who is over the age of thirty-five, to take the competitive civil service exam and be eligible for placement on an eligible list for appointment as a full-time police officer, contingent upon his exam score and ability to meet the physical fitness requirements of the position. SUMMARY OF PROVISIONS: Section 1 provides eligibility for taking the civil service exam for the position of full-time police officer, contingent upon his exam score. Section 2 subjects Officer Perri to the merit and fitness provisions for this position. Section 3 provides for an immediate effective date. EXISTING LAW: Section 58 of Civil Service Law requires applicants for the position of full-time police officer to be no older than thirty-five years of age. JUSTIFICATION: Recruiting and retaining well-qualified full-time police officers is challenging for small rural police departments. S 2. Joseph Perri shall otherwise be subject to the merit and fitness provisions of the civil service law applicable to full-time police offi- cers. S 3. This act shall take effect immediately.
