BILL NUMBER:S5320 TITLE OF BILL: An act to amend the executive law and the agriculture and markets law, in relation to police training regarding animal cruelty and protection laws PURPOSE: The purpose of this bill is to improve the education and training of police officers in animal cruelty and protection laws and make information about the laws readily available to police and prosecu- tors SUMMARY OF PROVISIONS: Section one amends paragraph (k) of subdivision 1 of section 840 of the executive law to include the Department of Agriculture and Markets in development of police training policies and procedures by the Municipal Police Training Council related to enforcement of animal cruelty and protection laws. The Council would also make provisions for education and training in such policies and procedures. Section two amends section 837 of the executive law by adding a new subdivision 20 that would require the Division of Criminal Justice Services to assist the Department of Agriculture and Markets in develop- ing information about animal cruelty and protection laws to be used by law enforcement.

RITCHIE, FUNKE, GRIFFO -- read twice and ordered printed, and when printed to be committed to the Committee on Finance AN ACT to amend the executive law and the agriculture and markets law, in relation to police training regarding animal cruelty and protection laws THE PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND ASSEM- BLY, DO ENACT AS FOLLOWS: Section 1. Paragraph (k) of subdivision 1 of section 840 of the execu- tive law, as added by chapter 492 of the laws of 2009, is amended to read as follows: (k) Development, maintenance and dissemination, IN CONSULTATION WITH THE DEPARTMENT OF AGRICULTURE AND MARKETS, of written policies and procedures pursuant to ANIMAL CRUELTY AND PROTECTION LAWS, INCLUDING, BUT NOT LIMITED TO, article twenty-six of the agriculture and markets law, section 352.3 of the family court act as it applies to companion animals, and applicable provisions of the penal law, regarding the investigation and prevention of any act of cruelty to animals. THE COUNCIL SHALL MAKE PROVISIONS IN SUCH POLICIES AND PROCEDURES FOR THE EDUCATION AND TRAINING IN ENFORCEMENT OF SUCH ANIMAL CRUELTY AND PROTECTION LAWS. S 2. Section 837 of the executive law is amended by adding a new subdivision 20 to read as follows: 20. TO ASSIST THE DEPARTMENT OF AGRICULTURE AND MARKETS IN DEVELOPING INFORMATION ABOUT ANIMAL CRUELTY AND PROTECTION LAWS PURSUANT TO SUBDI- VISION FORTY-EIGHT OF SECTION SIXTEEN OF THE AGRICULTURE AND MARKETS LAW. S 3. Section 16 of the agriculture and markets law is amended by adding a new subdivision 48 to read as follows: 48. MAKE AVAILABLE IN WRITTEN AND ELECTRONIC MEDIUM, IN A MANNER READ- ILY ACCESSIBLE TO POLICE AGENCIES AND OFFICERS AND DISTRICT ATTORNEYS, INFORMATION ABOUT ANIMAL CRUELTY AND PROTECTION LAWS IN THIS CHAPTER, EXPLANATION--Matter in ITALICS (underscored) is new; matter in brackets [ ] is old law to be omitted.
