 TITLE OF BILL :  An act to amend the local finance law, in relation
to authorizing and empowering the village of Amityville, county of
Suffolk, to amortize the cost of payments to certain employees upon
separation of service from the village

 PURPOSE :

To allow the village of Amityville to amortize the cost of payments to
employees upon separation of service from the village.

 SUMMARY OF PROVISIONS :

Section one of this bill amends paragraph a of section 11.00 of the
local finance law by adding a new subdivision 108 that empowers the
village of Amityville to amortize an accrued and accumulated but
unused and unpaid sick leave, personal leave, holiday leave, vacation
time, time allowances granted in lieu of overtime compensation and any
other forms of payment for time earned by employees of the village of
Amityville and payable to such employees upon separation of service
from the village. The bill permits the village to amortize separation
payments up to $870,000 made by the village on or after January 1,
2015.

Section two of this bill provides that this act shall take effect
              

immediately.

 JUSTIFICATION :

The village of Amityville has experienced unexpected and unplanned
retirements of two officers in the police department of the village.
The retirees are senior and high ranking members of the police
department of the village who have earned significant amounts of
accrued and accumulated but unused sick leave, personal leave, holiday
leave, vacation time, time allowances granted in lieu of overtime
compensation and any other forms of payment for time which is payable
to such retirees upon separation of service from the village. This has
created an unusual expense for the village and would impose a
significant financial hardship if the separation payments are required
to be paid immediately or during a limited time period. This
legislation would allow the village of Amityville to spread the impact
of the unplanned separation payments over a period of 10 years and
provide the village with time to replenish reserves established by the
village of Amityville for such purposes. Further, as part of ongoing
collective bargaining efforts with the union representing employees of
the police department of the village, the village of Amityville is
presently negotiating to impose limits on the amount of accrued and
accumulated but unused and unpaid sick leave, personal leave, holiday
leave, vacation time, time allowances granted in lieu of overtime
compensation and any other forms of payment for time that can be
earned by members of the village police department. The village of
Amityville also expects to realize current budgetary savings as a
result of the reduction in salaries attributable to the retirees by
the replacement of such retirees with lower paid employees.
