BILL NUMBER: S7252 TITLE OF BILL : An act to amend the correction law, in relation to directing the division of criminal justice services to notify the appropriate agencies, within 48 hours of the receipt of a change of address, or of enrollment, attendance, employment or residence at an institution of higher education by a sex offender PURPOSE OR GENERAL IDEA OF BILL : This bill will require the Division of Criminal Justice Services to notify local law enforcement of the change of residence of sex offenders in no more than forty-eight hours. SUMMARY OF SPECIFIC PROVISIONS : This bill requires the Division of Criminal Justice Services to notify local law enforcement in no more than forty-eight hours that a sex offender has had a change of address. This bill also requires the Division to notify law enforcement regarding a change of residence to another state, or a change of status at an institution of higher education. JUSTIFICATION : Currently, there is no time frame for the Division to report the

ORTT -- read twice and ordered printed, and when printed to be committed to the Committee on Crime Victims, Crime and Correction AN ACT to amend the correction law, in relation to directing the divi- sion of criminal justice services to notify the appropriate agencies, within 48 hours of the receipt of a change of address, or of enroll- ment, attendance, employment or residence at an institution of higher education by a sex offender THE PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND ASSEM- BLY, DO ENACT AS FOLLOWS: Section 1. Subdivisions 1, 3 and 4 of section 168-j of the correction law, subdivision 1 as amended, and subdivisions 3 and 4 as added by chapter 11 of the laws of 2002, are amended to read as follows: 1. Upon receipt of a change of address by a sex offender required to register under this article, BUT IN ANY EVENT NO MORE THAN FORTY-EIGHT HOURS AFTER SUCH RECEIPT, the division shall notify the local law enforcement agency having jurisdiction of the new place of residence and the local law enforcement agency where the sex offender last resided of the new place of residence. 3. The division shall, if the sex offender changes residence to anoth- er state, notify the appropriate agency within that state of the new place of residence WITHIN FORTY-EIGHT HOURS. 4. Upon receipt of a change in the status of the enrollment, attend- ance, employment or residence at an institution of higher education by a sex offender required to register under this article, BUT IN ANY EVENT NO MORE THAN FORTY-EIGHT HOURS AFTER SUCH RECEIPT, the division shall notify each law enforcement agency having jurisdiction which is affected by such change.
