BILL NUMBER: S7611 TITLE OF BILL : An act to amend the education law, in relation to the establishment of a school certificate title for school mental health practitioners PURPOSE : This bill creates a school certificate title for school mental health practitioners including licensed mental health counselors, licensed marriage and family therapists, licensed psychoanalysts and licensed creative arts therapists to allow schools districts to hire these licensed mental health professionals. SUMMARY OF SPECIFIC PROVISIONS : Section 1 amends of the Education Law directing the Commissioner to establish school certificate titles for school mental health practitioners licensed under Article 163 as a licensed mental health counselor, licensed marriage or family therapist, licensed psychoanalyst or licensed creative arts therapist. Section 2 establishes the effective date. JUSTIFICATION :

MARCELLINO -- read twice and ordered printed, and when printed to be committed to the Committee on Education AN ACT to amend the education law, in relation to the establishment of a school certificate title for school mental health practitioners THE PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND ASSEM- BLY, DO ENACT AS FOLLOWS: Section 1. Section 305 of the education law is amended by adding a new subdivision 55 to read as follows: 55. THE COMMISSIONER SHALL ISSUE REGULATIONS TO ESTABLISH A CERTIF- ICATE VALID FOR PUPIL PERSONNEL SERVICES AS A SCHOOL MENTAL HEALTH COUN- SELOR, SCHOOL MARRIAGE AND FAMILY THERAPIST, SCHOOL PSYCHOANALYST AND A SCHOOL CREATIVE ARTS THERAPIST. IN ADDITION TO ANY OTHER REQUIREMENT FOR CERTIFICATE ESTABLISHED IN REGULATIONS, A CANDIDATE FOR A CERTIFICATE ESTABLISHED BY THIS SUBDIVI- SION SHALL BE REGISTERED AND HOLD A VALID LICENSE PURSUANT TO ARTICLE ONE HUNDRED SIXTY-THREE OF THIS CHAPTER. S 2. This act shall take effect on the one hundred eightieth day after it shall have become a law; provided, however, that effective immediate- ly the department of education is authorized to promulgate any and all rules and regulations and to take any other measures necessary to imple- ment this act on or before such effective date.
