BILL NUMBER: S6264 TITLE OF BILL : An act to amend the agriculture and markets law, in relation to exempting dog license fees for deployed active military member's dogs PURPOSE OR GENERAL IDEA OF BILL : To exempt dog license fees for deployed active duty military member's dogs SUMMARY OF SPECIFIC PROVISIONS : Section one - amends the agriculture and markets law to add a new subdivision 30 to define "deployed active military member's dog". Section two amends subdivision 2 of section 110 of the agriculture and markets law to add deployed active military member's dog to the list of what a municipality may exempt from their licensing fees. Section three sets forth the effective date JUSTIFICATION : This bill allows municipalities the option to waive a licensing fee

FUNKE -- read twice and ordered printed, and when printed to be committed to the Committee on Agriculture AN ACT to amend the agriculture and markets law, in relation to exempt- ing dog license fees for deployed active military member's dogs THE PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND ASSEM- BLY, DO ENACT AS FOLLOWS: Section 1. Section 108 of the agriculture and markets law is amended by adding a new subdivision 30 to read as follows: 30. "DEPLOYED ACTIVE MILITARY MEMBER'S DOG" MEANS ANY DOG WHOSE OWNER IS AN ACTIVE MEMBER OF THE MILITARY THAT HAS RECEIVED AND PRESENTED ORDERS TO REPORT FOR MILITARY SERVICE WHICH REQUIRES TEMPORARY HOUSING WHILE THE OWNER IS FILLING THEIR SERVICE COMMITMENTS. S 2. Subdivision 2 of section 110 of the agriculture and markets law, as added by section 5 of part T of chapter 59 of the laws of 2010, is amended to read as follows: 2. Municipalities may exempt from their licensing fees any guide dog, hearing dog, service dog, war dog, working search dog, detection dog, police work dog, DEPLOYED ACTIVE MILITARY MEMBER'S DOG or therapy dog. Each copy of any license for such dogs shall be conspicuously marked "Guide Dog", "Hearing Dog", "Service Dog", "Working Search Dog", "War Dog", "Detection Dog", "Police Work Dog", "DEPLOYED ACTIVE MILITARY MEMBER'S DOG", or "Therapy Dog", as may be appropriate, by the clerk or authorized dog control officer. S 3. This act shall take effect immediately. EXPLANATION--Matter in ITALICS (underscored) is new; matter in brackets [ ] is old law to be omitted. LBD11940-01-5
